La doble instancia en la investigación fiscal

Abstract
En este trabajo, me abocare al derecho a la doble instancia establecida en el numeral 6º del
artículo 139º de la Constitución Política del Perú y su protección en la Investigación Fiscal,
teniendo en cuenta que la instancia plural es parte del derecho al debido proceso y la tutela
jurisdiccional efectiva y por ende se aplican en forma extensiva a la investigación que se realiza
en la fiscalía “investigación preliminar”.
Al culminar dicha etapa, el fiscal puede tomar la decisión de archivar o declarar la reserva de
la investigación, supuesto para el cual el inciso 5º y 6º del artículo 334º del Código Procesal
Penal del 2004, ha regulado la “Elevación de actuados”, consignado como único requisito que
se interponga dentro del quinto día de notificado, pero no ha dejado en claro su
naturaleza, puesto que no ha precisado si nos encontramos ante un recurso impugnatorio,
cómo es nuestra posición, la cual fundamentaremos en este artículo.
Además, desarrollaremos el porqué es necesario que ante la denegatoria de este recurso
elevación de actuados, se regule de forma específica el recurso de queja de derecho, que deberá
ser Interpuesto ante el Fiscal Superior, sumado a ello precisaremos por qué resulta necesario
que se regule de forma clara los requisitos para la admisión o no del recurso elevación de
actuados, como son la fundamentación de hecho, derecho y el agravio.
Puesto a que, soy de la posición que la fiscalía de primera instancia no puede ser una simple
mesa de partes, ya que mínimamente debe verificarse el cumplimiento de algunos requisitos
para su admisión o no. Es así que pretendemos que se esclarezca y modifique lo preceptuado
en el inciso 5º y 6º del artículo 334 del Código Procesal Penal.
In this work, I will focus on the right to double instance established in numeral 6 of article 139 of the Political Constitution of Peru and its protection in the Fiscal Investigation, taking into account that the plural instance is part of the right to due process and effective jurisdictional protection and therefore they apply extensively to the investigation carried out in the "preliminary investigation" prosecutor's office. At the end of this stage, the prosecutor can make the decision to file or declare the investigation confidential, a case for which paragraphs 5 and 6 of article 334 of the Criminal Procedure Code of 2004, has regulated the "Elevation of proceedings", stating as the only requirement that it be filed within five days of notification, but has not made its nature clear, since it has not specified whether we are facing an appeal, what is our position, which we will base on in this article. In addition, we will explain why it is necessary that, in the event of the denial of this appeal for the elevation of proceedings, the appeal for legal complaint, which must be filed before the Superior Prosecutor, be specifically regulated. In addition, we will specify why it is necessary to clearly regulate the requirements for the admission or not of the appeal for the elevation of proceedings, such as the factual, legal and grievance grounds. Since I am of the position that the first instance prosecutor's office cannot be a simple party table, since at least the fulfillment of some requirements for its admission or not must be verified. Thus, we intend to clarify and modify what is stipulated in paragraphs 5 and 6 of article 334 of the Criminal Procedure Code.
