Abstract
El presente trabajo de tesis postula que los derechos culturales establecidos en el primer
párrafo del artículo 27 de la Declaración Universal de los Derechos Humanos: 1) a tomar
parte libremente en la vida cultural de la comunidad; 2) a gozar de las artes; y 3) a
participar en el progreso científico y en los beneficios que de él resulten, constituyen
libertades. El concepto de libertad que se utiliza es el brindado por el jurista alemán
Robert Alexy, que la define como un tipo de derecho en el cual el titular es libre de hacer
o no hacer, independientemente de la participación de terceros. La propuesta es
sustentada con un trabajo de campo realizado sobre ocho casos de estudio de
ciudadanos que ejercen sus derechos culturales en interacción con el patrimonio cultural
inmueble de la ciudad de Lima – Perú, y se justifica en la necesidad de valorar los
derechos culturales como medio para generar la paz que garantiza la vigencia de los
derechos humanos, y además brindar elementos para una mejor valoración del
patrimonio cultural inmueble, reconociéndolo como importante recurso para el ejercicio
de los derechos culturales. Producto del trabajo también se expone una nueva
perspectiva sobre la interacción entre estas libertades culturales ciudadanas y las
obligaciones del Estado frente al patrimonio cultural.
This thesis paper postulates that the cultural rights established in the first paragraph of article 27 of the Universal Declaration of Human Rights: 1) take a free part in the cultural life of the community; 2) enjoy the arts; and 3) participate in scientific progress and the benefits that resulted from it, experienced freedoms. The concept of freedom that is used is that offered by the German jurist Robert Alexy, who defines it as a type of right in which the holder is free to do or not to do, regardless of the participation of third parties. The proposal is supported by a field work carried out on eight cases of study of citizens who exercise their cultural rights in interaction with the cultural heritage of the city of Lima - Peru, and justifies the need to value cultural rights as a means to generate peace that guarantees the validity of human rights, and also provide elements for a better valuation of cultural heritage, recognizing it as an important resource for the exercise of cultural rights. As a result of the work, a new perspective on the interaction between these citizen cultural freedoms and the State's obligations towards cultural heritage is also exposed.
