El eterno conflicto entre el usucapiente y el adquiriente registral

Resumen
Hace mucho tiempo viene acechando al mundo jurídico de los derechos reales
una problemática que hasta la fecha el legislador no le ha dado la importancia
debida para regular una solución específica. Dicho ello, la finalidad de este
artículo académico es exponer la colisión de dos derechos de propiedad entre
quien adquirió un bien inmueble mediante la prescripción adquisitiva – o también
conocida como “usucapión” – y quien adquirió el mismo bien a partir de la
información que publicitaba el registro.
La doctrina nacional no ha sido ajena a esta laguna normativa. Distintos autores
han buscado encontrar una solución pacífica a partir del estudio de otras figuras
jurídicas que recoge el código civil. Así, hay quienes afirman que la clave está
en el artículo 952, mientras que para otros es el artículo 2014 el responsable de
dar solución a esta llamativa controversia.
¿Cuál de las dos norma jurídicas citadas es la correcta? Ninguna. Lo cierto es
que, como se mencionó líneas arriba, no hay ninguna norma que regule en
concreto el supuesto de hecho planteado. Sin embargo, hay un artículo del
código civil cuya redacción amplia encaja en la problemática planteada dándole
una solución pacífica. ¿Cuál es ese artículo? Nada más y nada menos que el
artículo 2022 del código civil que regula el principio de oponibilidad.
This is a problem that, to date, the legislature has not given due importance in regulating a specific solution. That said, the purpose of this academic article is to address the conflict between two property rights: one between someone who acquired real estate through adverse possession—also known as usucaption— and another who acquired the same property based on information published in the registry. National legal scholarship has not been unaware of this regulatory gap. On the contrary, various authors have sought a peaceful solution by studying other legal concepts contained in the Civil Code. Thus, some argue that the key lies in Article 952, while others believe that Article 2014 is responsible for resolving this striking controversy. Which of the two cited legal provisions is correct? Neither. The truth is, as mentioned above, there is no specific provision that regulates the factual scenario presented. However, there is an article in the Civil Code whose broad wording fits the problem presented, offering a peaceful solution. Which article is that? None other than article 2022 of the civil code, which regulates the principle of enforceability.
