Decreto Legislativo 1500 y la regulación de la participación ciudadana en el sector ambiente

Abstract

En el presente trabajo académico, se realizará un análisis sobre el Decreto Legislativo Nº 1500 y su impacto en la regulación sobre participación ciudadana en el sector ambiente. Como resultado de la investigación realizada, se plateará la necesidad de adaptar el referido Decreto Legislativo a la regulación actual vigente. Lo cual conlleva también a identificar la importancia de actualizar los Reglamentos de Participación Ciudadana relacionados al sector ambiente, para poder regular los mecanismos virtuales de participación ciudadana. Como parte del análisis, se concluirá que así como ha cambiado el contexto en relación a la Emergencia Sanitaria y el Estado Nacional de Emergencia, se han modificado los fundamentos del Decreto Legislativo Nº 1500. Por lo tanto, es necesario analizar cuales son los efectos de la modificación de sus fundamentos. Teniendo en consideración que si bien la virtualidad ha implicado una gran oportunidad para la participación ciudadana, existen factores sobre la presencialidad que no pueden ser reemplazados, a razón de las características del Perú, como falta de acceso a energía o medios virtuales por parte de la población. Para sustentar las conclusiones planteadas en el presente trabajo, se realizará un estudio del marco normativo sobre la participación ciudadana en el sector ambiente, y cómo impactó la vigencia del Decreto Legislativo Nº 1500 en dicho marco normativo. De igual forma, se tomará en cuenta los informes de Defensoría del Pueblo para identificar cómo ha impactado la implementación de mecanismos virtuales en la población.

In this academic work, an analysis will be made of Legislative Decree No. 1500 and its impact on the regulation of citizen participation in the environmental sector. As a result of the research carried out, the need to adapt the referred Legislative Decree to the current regulation in force will be presented. This also leads to identify the importance of updating the Regulations of Citizen Participation related to the environmental sector, in order to regulate the virtual mechanisms of citizen participation. As part of the analysis, it will be concluded that just as the context has changed in relation to the Sanitary Emergency and the National State of Emergency, the foundations of Legislative Decree No. 1500 have been modified. Therefore, it is necessary to analyze the effects of the modification of its foundations. Taking into consideration that although virtuality has implied a great opportunity for citizen participation, there are factors that cannot be replaced due to the characteristics of Peru, such as the lack of access to energy or virtual media by the population. To support the conclusions raised in this paper, a study will be made of the regulatory framework on citizen participation in the environmental sector, and how the enforcement of Legislative Decree No. 1500 impacted this regulatory framework. Likewise, the reports of the Ombudsman's Office will be taken into account to identify how the implementation of virtual mechanisms has impacted the population.
