El test de proporcionalidad y el principio de razonabilidad en sede administrativa: propuesta práctica para su aplicación y control frente al ejercicio de las autoridades administrativas

Abstract
El presente trabajo pretende proporcionar a los operadores jurídicos, sean las autoridades
administrativas, a los mismos administrados o a los órganos jurisdiccionales que ejercen el
control sobre las decisiones administrativas, una herramienta que permita, tanto evaluar la
razonabilidad de una medida administrativa ex ante, como controlarla ex post.
Para ello, presentaremos una metodología analítica y escalonada basada en el test de
proporcionalidad empleado por nuestro y diversos Tribunales Constitucionales a lo largo del
mundo. De esa manera, utilizaremos el método histórica-descriptivo y analítica, comenzando
por comprender los antecedentes del antes mencionado examen y la forma en cómo se
emplea en diversos ordenamientos jurídicos; para, luego, delimitar el problema y explicar
nuestra metodología.
De esa manera, y para poner bajo escrutinio la propuesta que contiene esta investigación, la
analizaremos desde un caso concreto que fue conocido por la Comisión de Libre
Competencia y, en grado, por la Sala de Defensa de la Competencia del INDECOPI.
Luego, finalizaremos el presente trabajo con nuestras conclusiones y recomendaciones, a fin
de poder encontrar una fórmula discursiva que nos permita elevar el estándar argumentativo
actualmente empleado para el empleo del principio de razonabilidad en sede administrativo y
facilitar tanto su análisis ex ante como su control ex post.
The purpose of this research is to provide legal operators, whether they are governmental authorities, the citizens or the courts that exercise control over administrative decisions (judicial review), with a method that allows them to assess the reasonableness of an administrative measure ex ante, as well as to control it ex post. To do so, we will present an analytical and step-by-step methodology based on the balancing test used by our and various Constitutional Courts throughout the world. In doing so, we will use ahistorical-descriptive and analytical method, beginning by understanding the background of the aforementioned test and how it is used in various legal systems, and then defining the problem and explaining our methodology to resolve it. In this way, and in order to scrutinise the proposal contained in this research, we will analyse it from a specific case that was decided by the Free Competition Commission and by the Competition Defence Chamber of INDECOPI. Finally, we will end this research with our conclusions and recommendations, in the hope of finding a discursive formula that will allow us to raise the argumentative standard currently used for the use of the principle of reasonableness in administrative proceedings and facilitate both its ex ante analysis and its ex post control
