Abstract
A partir del análisis de las disposiciones normativas aplicables del sector financiero, la
regulación vigente en materia de IA, las acciones adoptadas frente a la problemática de
discriminación algorítmica en el marco internacional, así como los derechos
involucrados y potencialmente afectados frente a una situación de discriminación
algorítmica, será posible concluir si nuestra normativa nacional vigente se encuentra
debidamente estructurada para regular estos escenarios. En este orden de ideas, será
posible determinar qué tan tutelados se encuentran los consumidores financieros frente
a limitaciones injustificadas en el acceso a créditos por la presencia de sesgos
algorítmicos.
Based on the analysis of the applicable regulatory provisions of the financial sector, the current regulation regarding AI, the actions adopted against the problem of algorithmic discrimination in the international framework, as well as the rights involved and potentially affected in the face of a situation of discrimination. algorithmic, it will be possible to conclude whether our current national regulations are properly structured to regulate these scenarios. In this order of ideas, it will be possible to determine how protected financial consumers are against unjustified limitations in access to credit due to the presence of algorithmic biases.
