Resumen
El ordenamiento jurídico peruano, específicamente en el ámbito de protección al
consumidor se ha establecido la subsanación como un eximente de
responsabilidad administrativa. A mayor abundamiento, a través de diversa
jurisprudencia de la Comisión y la Sala de Protección al Consumidor se ha
determinado que, en caso de operaciones no reconocidas la subsanación implica
la pérdida de la legitimidad para obrar respecto a la operación u operaciones
materia de subsanación.
En el ámbito de protección al consumidor bancario se ha determinado el
despliegue de las medidas de seguridad entendidas como la verificación de la
validez y el monitoreo. El presente artículo busca, a través de la revisión de
diversa jurisprudencia y doctrina del sector, determinar el impacto de la figura de
la subsanación en el análisis de las operaciones controvertidas y su consecuente
efecto en la determinación de la responsabilidad administrativa.
A lo largo de este artículo se analizará la situación actual de la subsanación en
los procedimientos administrativos sancionadores seguidos contra entidades
bancarias a fin de determinar si se estaría afectando al consumidor.
The Peruvian legal system, specifically in the area of consumer protection, has established the correction as an exemption from administrative liability. Furthermore, through various jurisprudence of the Commission and the Consumer Protection Chamber, it has been determined that in the case of unrecognized transactions, the correction implies the loss of the legitimacy to act with respect to the transaction or transactions that are the subject of the correction. In the field of banking consumer protection, it has been determined the deployment of security measures understood as the verification of validity and monitoring. This article seeks, through the review of diverse jurisprudence and doctrine of the sector, to determine the impact of the figure of the cure in the analysis of the controversial operations and its consequent effect in the determination of the administrative responsibility. Throughout this article, the current situation of the remedy in administrative sanctioning proceedings against banks will be analyzed in order to determine whether the consumer is being affected.
