La correcta interpretación del delito de negociación incompatible: desde una perspectiva de la lucha contra la corrupción y aplicación de los principios del buen gobierno

Resumen
En el presente trabajo académico se ha analizado los elementos normativos del
delito de negociación incompatible para una correcta interpretación del tipo penal
por parte de los operadores de justicia en un contexto con fuerte incidencia a nivel
nacional por procesos en investigación. Asimismo, se ha abordado el fenómeno de
la corrupción y el grave impacto que este genera en los derechos humanos. Frente
a ello, se menciona que la lucha contra la corrupción ha sido reconocida como
principio constitucional por el cual todos los poderes del Estado están obligados a
combatirla en todas sus formas. Finalmente, se ha desarrollado el concepto de buen
gobierno y cómo este determina el correcto ejercicio del poder estatal a través de
sus principios relacionándolo con la correcta interpretación de la negociación
incompatible.
En tal sentido, se ha empleado doctrina, jurisprudencia nacional e internacional para
determinar que la correcta interpretación de este tipo penal genera la lucha contra
la corrupción en concordancia con los estándares internacionales en materia
anticorrupción. De esta manera, podemos hablar de un buen gobierno, el cual regula
el ejercicio del poder para un eficaz funcionamiento del Estado y la realización de
derechos humanos.
In the present academic work, the normative elements of the offense of incompatible negotiation have been examined in order to ensure a sound construction of this criminal provision by judicial and prosecutorial authorities, in a context in which offense has acquired significant nationwide relevance due to the increasing number of pending investigations. Likewise, the phenomenon of corruption and its severe impact on the effective enjoyment of human rights have been addressed. In this regard, it is underscored that the fight against corruption has been recognized as a constitutional principle, by virtue of which all branches of government are under an obligation to combat it in all its forms. Finally, this work develops the concept of good governance and explains how it frames the proper exercise of state power through its guiding principles, linking these to the correct interpretation of the offense of incompatible negotiation. Accordingly, doctrine and both national and international case law have been employed to establish that an appropriate interpretation of this criminal offense strengthens the fight against corruption, in harmony with international anti-corruption standards. In this manner, one may properly speak of good governance, understood as the framework that regulates the exercise of public power so as to ensure the effective functioning of the State and the realization of human rights.
