Abstract
En este trabajo se pretende abordar la situación jurídica de la gestación subrogada
transfronteriza en el Perú. Dicha práctica se produce cuando una persona soltera o
pareja decide viajar al extranjero para poder acceder a dicha técnica de reproducción
asistida para poder ser padres. Nuestro ordenamiento jurídico no prevé la regulación
de dicho conflicto porque, en principio, dicha práctica se encuentra proscrita. Sin
embargo, en la realidad social sí se producen estos casos, y no son pocos. Lo cual
termina generando diversos problemas jurídicos porque se genera un desfase jurídico
entre la regulación del país en la que recurrieron, conforme a su proyecto de vida,
para poder conformar una familia, y la peruana. Provocando una situación jurídica de
precariedad tanto de las personas que optaron por dicha técnica y los niños que nacen
a partir de ella, en el cual no se garantiza ni protege sus derechos fundamentales. En
ese sentido, este trabajo busca contribuir en la visibilidad de esta problemática social
en nuestro país y contribuir en el debate acerca de su regulación. Para lo cual, primero
realizaremos una aproximación a la regulación sobre esta práctica en otros países, a
partir del derecho comparado. Luego, abordaremos la regulación de dicha técnica
reproductiva en nuestro país y sus falencias.
In this work we intend to address the legal situation of cross-border surrogate pregnancy in Peru. Practical advice occurs when a single person or couple decides to travel abroad in order to access the assisted reproduction technique in order to become priests. Our legal system does not prevent the regulation of conflict because, in principle, this practice is prohibited. However, in social reality these cases only occur, but not few. This ends up generating several legal problems because a legal gap is generated between the regulation of the country in which they resort, according to their life project, to be able to form a family, and the Peruvian. Provoking a precarious legal situation for both people who opted for technical assistance and children who were born from it, in which their fundamental rights are not guaranteed or protected. In this sense, this work seeks to contribute to the visibility of this social problem in our country and to contribute to the debate about its regulation. To do this, we will first carry out an approach to the regulation of this practice in other countries, based on comparative law. Luego, we will address the regulation of reproductive technical advice in our country and its bankruptcy.
