Resumen
La presente investigación cuestiona la inexistencia de una regulación específica
en el Código Procesal Penal del Perú, sobre la posibilidad de aplicar
convenciones probatorias en juicio oral para casos de agresiones contra las
mujeres e integrantes de grupo familiar. Al respecto, identificaremos
primeramente en qué etapa del proceso tienen aplicación las convenciones
probatorias; para luego, establecer la postura del autor, señalando que existen
argumentos válidos e idóneos para incorporar convenciones probatorias en juicio
oral, sobre todo porque evitan la revictimización y contribuyen a una mejor tutela
jurisdiccional de la víctima. Siendo el aporte de este artículo el esbozar una
modificación normativa del artículo 373° del Código Procesal Penal, dinamizando
de esta manera el proceso penal en esta clase de delitos.
This research questions the lack of a specific regulation in the Peruvian Code of Criminal Procedure on the possibility of applying evidentiary conventions in oral trials in cases of aggression against women and family members. In this regard, the article first identifies at what stage of the process evidentiary conventions are applicable and then establishes the author's position, pointing out that there are valid and suitable arguments for incorporating evidentiary conventions in oral trials, especially because they avoid revictimization and contribute to a better jurisdictional protection of the victim.
