Abstract
Es sabido que, en nuestro ordenamiento procesal penal, el legislador ha establecido de
manera taxativa la inimpugnabilidad en casos de aplicación de la prueba de oficio. En ese
contexto, se analizará en el desarrollo del presente artículo, si es válido la interposición de
algún medio impugnatorio que nos permita que la decisión jurisdiccional que admite la
prueba de oficio sea revisada por un tribunal y cuál es el medio impugnatorio idóneo para
nuestros fines. Otro tópico se centra en establecer cuáles son los supuestos o bajo qué
criterios los sujetos procesales, pueden cuestionar la actividad oficiosa del juzgador en la
aportación unilateral de la prueba en el proceso, en esa búsqueda de obtener la verdad, ello
teniendo en cuenta la trascendencia que significa la aplicación de tal figura, la cual muchas
veces puede ser decisiva el desarrollo final de la causa sometida al fuero jurisdiccional.
Para tratar de dar una respuesta a nuestro problema planteado, se analizará la jurisprudencia
de reciente data emitida por la Corte Suprema de la República, que aborda de cierta manera
el estado de la cuestión, para concluir después del análisis respectivo, que resulta válido la
interposición de medios impugnatorios para cuestionar la prueba de oficio, mediante el
recurso por excelencia apelación y queja, todo ello con el único fin de realizar algún aporte
en la praxis a los sujetos procesales, en un tema tantas veces cuestionado como la prueba
de oficio.
It is known that, in our criminal procedural order, the legislator has exhaustively established the non-challenge in cases of application of the ex officio test. In this context, it will be analyzed in the development of this article, if it is valid the filing of some impugnative means that allows us that the jurisdictional decision that admits the ex officio test is reviewed by a court and what is the ideal impugnative means for our purposes. Another topic focuses on establishing what the assumptions are or under what criteria the procedural subjects can question the informal activity of the judge in the unilateral provision of evidence in the process, in that search to obtain the truth, taking into account the significance which means the application of such a figure, which many times can be decisive in the final development of the case submitted to the jurisdiction. To try to give an answer to our problem, the recent jurisprudence issued by the Supreme Court of the Republic will be analyzed, which addresses in a certain way the state of the matter, to conclude after the respective analysis that the filing is valid. of challenging means to question the ex officio evidence, by means of the appeal par excellence and complaint, all with the sole purpose of making some contribution in the praxis to the procedural subjects, on a subject so many times questioned as the ex officio evidence.
