Fundamentos para una concepción de justicia a partir de la lucha entre escuelas jurídicas

Abstract
El trabajo de investigación tiene como propósito la elaboración de los Fundamentos para
una nueva concepción de justicia a través de la lucha de escuelas jurídicas, a fin de evitar
la inconmensurabilidad de los diálogos jurídicos en un proceso judicial que conlleva a
resolver el conflicto a través de la imposición de algún tipo de justicia que no
necesariamente es coherente y consistente a la concepción de justicia que tienen los
procesados, lo cual conlleva a superar el mencionado problema con el derecho propuesto
en la presente tesis: “Toda persona tiene derecho a elegir, a guiarse y a ser sometido bajo
una determinada concepción de justicia coherente y consistente”, esto implica que el
procesado, quién piensa, habla y actúa bajo una determinada concepción de justicia sea
juzgado en conformidad a un determinado sistema de administración de justicia coherente
y consistente. Para el desarrollo y ejecución de la tesis, se ha utilizado la metodología de la
concepción informática de Solomnof y el método axiomático aplicado a las ciencias
sociales, con el objetivo de verificar las propiedades básicas de una teoría; por lo que los
resultados fueron los siguientes: (a) la propiedad de la teoría propuesta carece de
completitud, por cuanto no se sabe cuántos tipos de justicia, escuelas jurídicas o fuentes
del derecho puedan crearse a futuro, a éste tipo de deficiencia se la denomina incompletitud
semántica; sin embargo (b) la teoría en mención ha probado ser consistente y
axiomatizable. Es por ello que se llegó a las siguientes conclusiones: (1) Sólo 6 escuelas
jurídicas pueden ser consideradas como tales por cumplir sus requisitos básicos; y (2) la
escuela de la argumentación jurídica aplicado en el Estado peruano es INCOSISTENTE.
The purpose of the research work is to elaborate the Fundamentals for a new conception of justice through the struggle of legal schools, in order to avoid the incommensurability of legal dialogues in a judicial process that entails resolving the conflict through the imposition of some kind of justice that is not necessarily coherent and consistent with the conception of justice that the accused have, which leads to overcome the mentioned problem with the right proposed in this thesis: "Every person has the right to choose, guiding and being subjected to a certain conception of consistent and consistent justice, "this implies that the accused, who thinks, speaks and acts under a particular conception of justice, is judged in accordance with a coherent and consistent system of administration of justice. For the development and execution of the thesis, Solomnof's computer conception methodology and the axiomatic method applied to the social sciences have used, in order to verify the basic properties of a theory; the results were as follows: (a) ownership of the proposed theory lacks completeness, since it is not known how many types of justice, legal schools or sources of law can be created in the future, then this type of deficiency is It is called semantic incompleteness; However (b) the theory in question has proved to be consistent and axiomatizable. It is for this reason that the following conclusions were reached: (1) Only 6 legal schools can be considered as such because they meet their basic requirements; and (2) the school of legal argumentation applied in the peruvian State is INCOSISTENT.
