Viabilidad de la excepción de improcedencia de acción en el delito de Financiamiento Prohibido de Organizaciones Políticas en el Perú

Abstract
El presente trabajo analiza la regulación del delito de financiamiento prohibido de
organizaciones políticas, en el marco de aquellas conductas anteriores a la entrada en
vigencia de la norma que incorpora el referido tipo penal a nuestro ordenamiento jurídico,
con el objetivo de determinar si es posible sancionar penalmente con otros tipos penales
afines; asimismo, establecer si es viable la fundabilidad de la excepción de improcedencia
de acción en este marco de conductas. En tal sentido, se estudian algunos aspectos de
tipicidad del tipo base y las fuentes de financiamiento legalmente prohibidas, así como
los tipos penales afines al delito de financiamiento prohibido de organizaciones políticas,
la atipicidad de este delito en algunos supuestos como en la financiación de origen público
de los partidos políticos, las condonaciones de deuda en el financiamiento privado, en
donde cabrían escenarios en los cuales sería factible la fundabilidad de la excepción de
improcedencia de acción.
La reforma que incorpora el delito de financiamiento prohibido de organizaciones
políticas, evidencia que, en nuestro ordenamiento jurídico existía un vacío legal respecto
de algunas conductas de financiamiento prohibido de partidos políticos, no obstante, se
puede verificar que, en algunos casos, existen conductas que se pueden reconducir a otros
tipos penales afines, como por ejemplo al delito de lavado de activos y delitos contra la
administración pública, el delito de cohecho, tráfico de influencias y otros, así como
también los delitos contra la fe pública – falsedad ideológica, donde se pueden sancionar
penalmente.
This paper analyzes the regulation of the crime of prohibited financing of political organizations, within the framework of those conducts prior to the entry into force of the norm that incorporates the aforementioned criminal type into our legal system, with the aim of determining whether it is they can penalize criminally with other related criminal types, likewise, establish whether the foundations of the exception of inadmissibility of action in this framework of conduct is viable. In this sense, some aspects of the basic type and the legally prohibited sources of financing are studied, as well as the criminal types related to the crime of prohibited financing of political organizations, the atypicality of this crime in some cases, such as source financing. public of political parties, debt forgiveness in private financing, where there would be scenarios in which the foundations of the exception of inadmissibility of action would be feasible. The reform that incorporates the crime of prohibited financing of political organizations, evidences that, in our legal system, there was a legal vacuum regarding some conducts of prohibited financing of political parties, however, it can be verified that, in some cases, there are conducts that They can be redirected to other related criminal types, such as the crime of money laundering and crimes against public administration, the crime of bribery, influence peddling and others, as well as crimes against public faith - ideological falsehood, where they can be penalized.
