Reflexiones en torno a la regulación del procedimiento de negociación colectiva del Sector Público en la Ley N° 31188

Abstract

El trabajo de investigación parte de analizar la regulación del procedimiento a la negociación colectiva establecida por la Ley N° 31188, desde el desarrollo normativo y jurisprudencial del derecho constitucional a la negociación colectiva. Asimismo, dicho análisis aterriza en tres ejes del procedimiento negocial, a la luz de su naturaleza y sus principios, así como de los principios presupuestales previstos en la Constitución. Con ello, determinar si la regulación actual corresponde a una intervención estatal legítima y respetuosa del derecho a la negociación colectiva en el sector público.The research work starts from analyzing the regulation of the collective bargaining procedure established by Law No. 31188, from the normative and jurisprudential development of the constitutional right to collective bargaining. Likewise, said analysis lands on three axes of the negotiation procedure, in light of its nature and its principles, as well as the budgetary principles established by the Constitution. With this, it is determined whether the current regulation corresponds to a legitimate state intervention and respectful of the right to collective bargaining in the public sector.
