La motivación en el arbitraje: análisis sobre su función y rol en los laudos arbitrales

Abstract
El presente artículo tiene como finalidad abordar cuál es el rol que
cumple la motivación en el arbitraje y cómo ésta puede ser concebida al
momento que se efectúe el análisis en un laudo arbitral.
El debido proceso, en sus distintas manifestaciones, tiene ciertas
particularidades en el arbitraje. Uno de los aspectos que representan ciertas
posturas encontradas es el de la motivación de los laudos arbitrales y la
exigencia de ciertos elementos al momento de su control en sede judicial. En tal
sentido, la atención se centrará en analizar los aspectos más relevantes de las
teorías sobre la naturaleza del arbitraje, para analizar el rol que tiene la adecuada
motivación en los laudos arbitrales.
Finalmente, se reflexionará sobre la motivación en el arbitraje y su relación con
la imparcialidad del árbitro, como mecanismo de control posterior por las partes
de un proceso arbitral.
The purpose of this article is to approach the role and function that due motivation has in arbitration processes in general, and to further understand and delimitate its conception in regard to the analysis of a valid arbitration award. Due process, in its different manifestations, has certain peculiarities when it comes to arbitration. One of the most controversial topics is the motivation of arbitration awards and the requirements of certain elements in respect to an eventual judicial control. In that regard, attention will be focused on analyzing the relevant aspects of the theories on the legal foundation of arbitration in order to examine due motivation of arbitration awards. Finally, we will reflect on the relation between due motivation and the impartiality of arbitrators, as a way of post control to determine if an arbitration award is valid or not.
