Resumen
La entrevista única es un método adoptado por el ordenamiento procesal peruano destinado a
recibir el testimonio de menores de edad víctimas de delitos sexuales con el apoyo de un
psicólogo y en un ambiente denominado cámara Gesell, para evitar la revictimización y
declaraciones reiterativas, sin embargo ha estado sujeto a cuestionamientos a partir de
alegaciones de vulneración del derecho de defensa respecto a su principio de contradicción.
Por ello este trabajo de investigación buscó ofrecer una perspectiva de los aportes que la
entrevista única brinda a la conservación del medio de prueba mediante la participación del
psicólogo con sus protocolos de entrevista forense y al respeto de la actuación del medio de
prueba a través del trámite de prueba anticipada con participación de Juez de Investigación
Preparatoria para garantizar el contradictorio y el interés superior del niño. En consecuencia,
para este artículo, se utilizó una metodología propia de la investigación jurídica dogmática, la
cual incluye la revisión y análisis de normativa, jurisprudencia, doctrina y artículos
científicos, se tuvo como objetivo general establecer que la entrevista única en Cámara Gesell
puede armonizar las manifestaciones del derecho fundamental a probar y el interés superior
del niño en los menores de edad víctimas de delitos sexuales.
The single interview is a method adopted by the Peruvian procedural system aimed at receiving the testimony of minors who are victims of sexual crimes with the support of a psychologist and in an environment called the Gesell chamber, to avoid re-victimization and repetitive statements, however it has been subject to questioning based on allegations of violation of the right of defense regarding its principle of contradiction. For this reason, this research work seeks to offer a perspective of the contributions that the single interview offers to the conservation of the means of evidence through the participation of the psychologist with his forensic interview protocols and respect for the performance of the means of evidence through the procedure. advance evidence with the participation of the Preparatory Investigation Judge to guarantee the contradictory and the best interests of the child. Consequently, for this article, which used a methodology of dogmatic legal research, which includes the review and analysis of regulations, jurisprudence, doctrine and scientific articles, the general objective was to establish that the single interview in Gesell Chamber can harmonize the manifestations of the fundamental right to prove and the best interest of the child in minors who are victims of sexual crimes.
