Fortalecimiento de la función inspectiva con el establecimiento de un modelo de integridad alineado a los principios y finalidad del Sistema de Inspección del Trabajo

Abstract

Las entidades estatales han demostrado en los últimos años un progresivo interés por consolidar mecanismos para prevenir y acometer los embates de la corrupción. Con estos fines, han llevado a la práctica recomendaciones de la Secretaría de Integridad Pública de la Presidencia del Consejo de Ministros, diseñadas para aplicarse en todos los niveles y organismos del gobierno en función de los componentes del Modelo de Integridad Pública. Esta implementación —que se inicia en el año 2021 y se mantiene vigente hasta el cierre de esta investigación— se traduce en mediciones del Índice de Capacidad Preventiva frente a la Corrupción, que expresa el grado de aplicación del modelo y determina cuáles son las brechas que corresponden resolverse con la ejecución de acciones posteriores estratégicas y puntuales. Al constituirse como un objetivo estatal la lucha contra la corrupción, el Modelo de Integridad debe ser implementado en todos los sistemas de las entidades del Estado, lo que incluye al Sistema de Inspección del Trabajo, a cargo de la Superintendencia Nacional de Fiscalización Laboral (Sunafil). Dado que está a cargo de la labor inspectiva de trabajo, a través de sus inspectores indaga en los ámbitos laboral, de salud, social y de seguridad en el trabajo. Estas actuaciones inspectivas se producen antes del procedimiento sancionador establecido en el Reglamento de la Ley General de Inspección del Trabajo. En ese marco, el proyecto “Publicidad de las inspecciones laborales en tiempo real” surge como una propuesta innovadora para dotar de una herramienta útil y necesaria para elevar el estándar de integridad con el que deben desempeñarse los inspectores del trabajo en el desarrollo de la investigación. Con esto, coadyuva a fortalecer la transparencia, pues al publicar sus indagaciones en tiempo real, desalienta la concurrencia de conductas contrarias al ordenamiento jurídico penal y al propio ordenamiento que rige la conducta de los inspectores del trabajo.

In recent years, state entities have shown a progressive interest in consolidating mechanisms to prevent and tackle the onslaught of corruption. To this end, they have put into practice the recommendations of the Secretariat of Public Integrity of the Presidency of the Council of Ministers, designed to be applied at all levels and agencies of government according to the components of the Public Integrity Model. This implementation -which begins in 2021 and remains in effect until the close of this investigation- is translated into measurements of the Index of Preventive Capacity against Corruption, which expresses the degree of application of the model and determines which are the gaps that should be solved with the execution of subsequent strategic and specific actions. Since the fight against corruption is a State objective, the Integrity Model must be implemented in all the systems of the State entities, including the Labor Inspection System, which is in charge of the National Superintendence of Labor Inspection (Sunafil). Since it is in charge of the labor inspection work, through its inspectors it investigates in the labor, health, social and safety at work areas. These inspections are carried out prior to the sanctioning procedure established in the Regulations of the General Labor Inspection Law. Within this framework, the project “Publicizing labor inspections in real time” arises as an innovative proposal to provide a useful and necessary tool to raise the standard of integrity with which labor inspectors must perform in the development of the investigation. With this, it helps to strengthen transparency, since by publishing their investigations in real time, it discourages the concurrence of conducts contrary to the criminal legal system and to the very system that governs the conduct of labor inspectors.
