Abstract
El trabajo evalúa si el principio de seguridad jurídica en la aplicación de la
declaratoria de rebeldía se encuentra afectado. Sobre ello, se propone la
hipótesis de que efectivamente existe una vulneración contra dicho principio, la
misma que se produce cuando el juez aplica la técnica de la prueba de oficio
bajo los parámetros de la sexta regla del X Pleno Casatorio Civil sobre hechos
en los que se declaró previamente la presunción legal relativa de verdad.
El trabajo desarrolla principalmente que la sexta regla del X Pleno Casatorio Civil
vulnera el principio de seguridad jurídica, debido a que su aplicación desconoce
o incluyo niega la importancia de la existencia de la convicción judicial como
presupuesto para que el juzgador llegue a la conclusión de declarar la presunción
legal relativa de verdad. Asimismo, la sexta regla desconoce la importancia de la
ausencia de convicción judicial para que el juzgador pueda aplicar la técnica de
la prueba de oficio.
Finalmente, el trabajo propone la modificación de la sexta regla del X Pleno
Casatorio Civil, la cual debería realizarse bajo los parámetros del Código
Procesal Civil. Mientras ello ocurre, los operadores de justicia podrían optar por
una interpretación de la sexta regla que no vulnere el principio de seguridad
jurídica.
The paper evaluates whether the principle of legal certainty in the application of the declaration of default is affected. Regarding this, the hypothesis is proposed that there is actually a violation against said principle, the same one that occurs when the judge applies the technique of the evidence ex oficio under the parameters of the sixth rule of the X Civil Cassation Plenary on facts in which the relative legal presumption of truth was declared. The paper mainly develops that the sixth rule of the X Civil Cassation Plenary violates the principle of legal certainty, because its application ignores or even denies the importance of the existence of the judicial conviction as a presupposition for the judge to reach the conclusión of declaring the relative legal presumption of truth. Likewise, the sixth rule ignores the importance of the absence of judicial conviction so that the judge can apply the technique of the evidence ex officio. Finally, the paper proposes the modification of the sixth rule of the X Civil Cassation Plenary, which should be carried out under the parameters of the Civil Procedure Code. While this is happening, justice operators could opt for an interpretation of the sixth rule that does not violate the principle of legal certainty.
