Propuesta de aplicativo digital para reducir el alto nivel de insatisfacción de los usuarios por la inoportunidad de la notificación de imputación de cargos por comisión de infracciones por parte de la SUNAFIL en Lima Metropolitana entre los años 2020 y 2021

Abstract
La Superintendencia Nacional de Fiscalización Laboral (SUNAFIL) cumple el rol
de autoridad central y ente rector del Sistema de Inspección del Trabajo,
teniendo entre sus finalidades la vigilancia y exigencia del cumplimiento de la
normatividad legal en el orden sociolaboral.
Al determinarse que los empleadores incurrieron en infracciones a la
normatividad verificada, se emite un Acta de Infracción, iniciándose el
Procedimiento Administrativo Sancionador con la notificación de imputación de
cargos, que comprende actos y diligencias que conducen a la determinación de
responsabilidad administrativa en la comisión de infracciones.
Empero, la normativa vigente no establece plazos entre la emisión del Acta de
Infracción y la imputación de cargos, siendo frecuente la imputación luego de
meses, generando insatisfacción al usuario (trabajador denunciante),
evidenciándose mediante reclamos del libro de reclamaciones.
El retraso administrativo fue identificado como causa con mayor impacto sobre
nuestro problema, planteándose el desafío de innovación: “¿Cómo podemos
reducir la alta insatisfacción por el retraso administrativo en el proceso de
notificación de imputación de cargos por comisión de infracciones por parte de
la SUNAFIL en lima metropolitana porque actualmente presentan inoportunidad
en la notificación de este servicio?”. Se realizó la propuesta de solución
“CONOCE TU PROCEDIMIENTO INSPECTIVO”, siendo prototipada, testeada y validada por usuarios, servidores y funcionarios. El proyecto de innovación tiene
previsto implementarse mediante un aplicativo digital, que reduzca la
insatisfacción, permitiendo conocer de forma más transparente el estado y
resultado del procedimiento, reduciendo los reclamos.
The National Superintendency of Labor Inspection (SUNAFIL) plays the role of central authority and governing body of the Labor Inspection System, having among its purposes the surveillance and demand of compliance with legal regulations in the socio-labor order. When it is determined that the employers incurred violations of the verified regulations, an Infraction Record is issued, initiating the Administrative Sanctioning Procedure with the notification of the imputation of charges, which includes acts and proceedings that lead to the determination of administrative responsibility in the commission of violations. However, the current regulations do not establish deadlines between the issuance of the Infraction Report and the imputation of charges, with accusations frequently being made after months, generating dissatisfaction for the user (reporting worker), evidenced by complaints in the complaints book. Administrative delay was identified as the cause with the greatest impact on our problem, posing the innovation challenge: “How can we reduce the high dissatisfaction due to the administrative delay in the process of notification of charges for commission of infractions by SUNAFIL in metropolitan Lima because they currently present inopportunity in the notification of this service?” The solution proposal “KNOW YOUR INSPECTION PROCEDURE” was made, being prototyped, tested and validated by users, servers and officials. The innovation project is planned to be implemented through a digital application, which reduces dissatisfaction, allowing the status and results of the procedure to be known in a more transparent way, reducing complaints.
