Abstract
El presente trabajo de investigación comprende una situación problemática en el
ámbito procesal penal, concretamente la tutela de la víctima en la ejecución de
fallos condenatorios con pena suspendida o no privativas de la libertad del
sentenciado; de ese modo, especificamos las limitaciones que presenta la
regulación procesal vigente que impiden al agraviado asumir un rol activo para
ver satisfecho la reparación civil que le fue fijada a su favor en la sentencia, pues
su participación está supeditada a la previa intervención del Ministerio Público.
En ese entender, además de exponer nociones teóricas necesarias para un mejor
entendimiento y tratamiento del estado de la cuestión, bajo un método descriptivo,
concluiremos que los mecanismos de tutela de la víctima en la ejecución de
sentencias con pena suspendida no son adecuados ni suficientes para dotar de
eficacia a la reparación civil; por lo que, siguiendo una interpretación sistemática,
constitucional y convencional, concluiremos que se debe permitir su participación
activa en dicha etapa del proceso con la finalidad que pueda exigir el resarcimiento
por el daño que le fue causado por la comisión del delito, sin excluir las facultades
inherentes del Ministerio Público vinculadas al control de la legalidad y la
ejecución de las penas.
This research work includes a problematic situation in the criminal procedural field, specifically the protection of the victim in the execution of convictions with suspended sentences or non-custodial sentences of the sentenced person; In this way, we specify the limitations presented by the current procedural regulation that prevent the aggrieved from assuming an active role to see satisfied the civil compensation that was established in his favor in the sentence, since his participation is subject to the prior intervention of the Public Ministry . In this understanding, in addition to exposing theoretical notions necessary for a better understanding and treatment of the state of the matter, under a descriptive method, we will conclude that the mechanisms of protection of the victim in the execution of sentences with suspended sentences are neither adequate nor sufficient to make civil reparation effective; Therefore, following a systematic, constitutional and conventional interpretation, we will conclude that their active participation in said stage of the process should be allowed in order to demand compensation for the damage that was caused by the commission of the crime, without excluding the Inherent powers of the Public Ministry linked to the control of legality and the execution of penalties.
