Situación del derecho al desarrollo en el contexto de la pandemia y la cooperación internacional

Abstract
El presente artículo pretende analizar si la cooperación internacional es la clave
para contribuir al cumplimiento de parte de los Estados a garantizar del
derecho al desarrollo afectado durante la crisis sanitaria internacional de la
COVID-19. En ese sentido, se toma en consideración la finalidad de la
cooperación internacional, el derecho el desarrollo y las acciones de los
Estados y de la comunidad internacional frente a dicha crisis, con miras a
proponer algunas medidas que a futuro se podrían considerar para garantizar
el ejercicio del derecho al desarrollo ante futuras crisis como la generada por la
pandemia.
Luego del análisis pertinente, se determina que, mediante la cooperación
internacional, los Estados pueden contribuir al cumplimiento de los ODS
establecidos en la Agenda 2030, la misma que, si bien no es un documento
jurídicamente vinculante, sirve como pauta para dirigir las acciones de los
Estados con miras a lograr metas de carácter mundial. Asimismo, el derecho al
desarrollo es un derecho humano, cuya finalidad es que los seres humanos
cuenten con las condiciones adecuadas que les permitan el goce efectivo de
sus derechos humanos que permitan a su vez su desarrollo en diversas áreas.
Finalmente, la cooperación internacional contribuye a que los Estados puedan
desarrollar acciones que permitan y garanticen el derecho al desarrollo frente a
futuras crisis sanitarias de carácter internacional como la generada por la
COVID-19, toda vez que brinda herramientas que facilitan la adopción de
dichas medidas.
This article aims to analyze whether international cooperation is the key to contributing to compliance by States to guarantee the right to development during the international health crisis of COVID-19. In this sense, the purpose of international cooperation, development law and the actions of States and the international community in the face of said crisis are taken into consideration, with a view to proposing some measures that could be considered in the future to guarantee the exercise of the right to development in the face of future crises such as the one generated by the pandemic. After the pertinent analysis, it is determined that, through international cooperation, the States can contribute to the fulfillment of the SDGs established in the 2030 Agenda, which, although it is not a legally binding document, serves as a guideline to direct the actions of States with a view to achieving global goals. Likewise, the right to development is a human right, whose purpose is that human beings have the adequate conditions that allow them to effectively enjoy their human rights, which in turn allow their development in various areas. Finally, international cooperation helps States to develop actions that allow and guarantee the right to development in the face of future international health crises such as the one generated by COVID-19, since it provides tools that facilitate the adoption of such measures.
