Abstract
La presente investigación aborda una problemática central en el sector de las
apuestas deportivas, un área en constante expansión donde los consumidores
interactúan regularmente con plataformas de apuestas en línea. En particular, se
examina si puede generarse una expectativa legítima de consumo sobre la base de
una oferta errónea y si los proveedores están obligados a cumplir con una oferta que
presenta vicios en su voluntad. Para ello, se analiza la Resolución N° 1578-2022/SPCINDECOPI,
en la que se discute el caso de un error evidente en las cuotas de una
casa de apuestas deportivas, y se establece que tal error desnaturaliza el contrato,
justificando la negativa del proveedor a cumplir con la oferta. Esta investigación se
enfoca en los límites de la responsabilidad de los proveedores y en cómo los errores
en las ofertas afectan las expectativas de los consumidores, enmarcando la discusión
dentro del principio de buena fe y el Código de Protección y Defensa del Consumidor.
A través de esta reflexión, se examina la anulación de ofertas viciadas, destacando el
equilibrio entre la protección del consumidor y la preservación de la transparencia y
competencia en el mercado.
This research addresses a central issue in the field of consumer relationships within the sports betting sector, a rapidly expanding area where consumers regularly engage with online betting platforms. Specifically, it explores whether a legitimate consumer expectation can be formed based on an erroneous offer, and whether providers are obligated to fulfill an offer that contains defects in its intention. The study analyzes Resolution No. 1578-2022/SPC-INDECOPI, which discusses a case involving an obvious error in the odds of a sports betting company, determining that such an error invalidates the contract and justifies the provider’s refusal to fulfill the offer. The investigation focuses on the limits of provider responsibility and how errors in offers affect consumer expectations, framing the discussion within the principle of good faith and the Consumer Protection and Defense Code. Through this analysis, the study examines the cancellation of defective offers, highlighting the balance between consumer protection and maintaining market transparency and competition.
