Abstract
La maternidad subrogada, como técnica de reproducción asistida, enfrenta un
vacío normativo en el Perú, lo que perpetúa desigualdades económicas y
legales. Esta práctica, aunque reconocida como parte de los derechos
reproductivos, se encuentra limitada por una legislación que prioriza los métodos
anticonceptivos, mientras ignora la dimensión positiva de estos derechos: la
posibilidad de procrear. Esto genera barreras de acceso que benefician
exclusivamente a quienes cuentan con recursos económicos, dejando en
situación de vulnerabilidad a las mujeres gestantes y excluyendo a quienes
desean formar una familia.
La regulación debe garantizar el acceso universal a la maternidad subrogada,
respetando el principio de igualdad y no discriminación. Además, debe
establecer condiciones éticas que protejan a todas las partes involucradas,
promoviendo un equilibrio entre los avances tecnológicos y los derechos
fundamentales. Así, se asegura una sociedad más justa e inclusiva, donde los
derechos reproductivos sean respetados en toda su amplitud.
Surrogacy, as an assisted reproductive technology, confronts a regulatory vacuum in Peru, perpetuating economic and legal inequalities. Although recognized as part of reproductive rights, this practice is limited by legislation that prioritizes contraceptive methods, while neglecting the positive dimension of these rights: the ability to procreate. This creates access barriers that exclusively benefit those with economic resources, leaving surrogate mothers in a vulnerable position and excluding those who wish to start a family. Regulation must guarantee universal access to surrogacy, respecting the principles of equality and non-discrimination. Additionally, it should establish ethical conditions that protect all parties involved, promoting a balance between technological advances and fundamental rights. In this way, a more just and inclusive society is ensured, where reproductive rights are respected in all their breadth
