Abstract
Los derechos fundamentales tienen un reconocimiento en los instrumentos
internacionales, uno de ellos, es el debido proceso, que es trascendental, para toda
persona que es parte de una investigación en un procedimiento o un proceso
judicial, administrativo o de cualquier otra índole donde exista una sanción punitiva.
En este contexto, el objetivo del trabajo, es el analizar la falta de criterios
determinantes para establecer la competencia entre el fuero común y fuero militar
en las investigaciones penales a las que son sometidos los policías y militares, para
evitar la vulneración de derechos fundamentales como el debido proceso, principio
del ne bis in ídem, derecho a un juez predeterminado por ley y al derecho de
defensa.
En el ámbito metodológico, el estudio utilizara un enfoque cualitativo, el tipo
es básico, de nivel correlacionar entre ambas variables, se realizará un análisis de
la información relevante de las categorías, objeto de estudio, a través de la
argumentación jurídica, para ello se ha obtenido tesis nacionales e internacionales,
jurisprudencia nacional e internacional, unido a la observación de la investigadora.
