Igualdad salarial en el Perú: búsqueda de estrategias para alcanzar los fines normativos

Resumen
Este articulo tiene por finalidad visibilizar que aun cuando se ha implementado la
normativa laboral sobre igualdad salarial en Perú, esta persiste. Para ello, hace
un repaso de normativa laboral supranacional sobre igualdad salarial entre
hombres y mujeres, además de la normativa nacional. Luego de ello, se analiza
y revisa la situación e impacto del desarrollo normativo sobre igualdad salarial
en el mercado laboral. Para el desarrollo de este extremo presentan algunas
características de la conformación del mercado laboral peruano en el sector
privado, se revisa el nivel de cumplimiento de este sector y finalmente analiza
algunas de las posibles causas de incumplimiento.
En atención a las posibles causas de incumplimiento, se revisa la experiencia
internacional respecto a la implementación de la normativa sobre igualdad
salarial a nivel regional – casos Argentina y Chile, y a nivel europeo. Entre las
diversas herramientas utilizadas por los países señalados en el artículo para
cumplir con los fines de la normativa de igualdad salarial para trabajo de igual
valor, resalta la utilizada por España: Plan de Igualdad Salarial, que constituye
una medida programática para el cierre de brecha salarial y puede significar una
herramienta útil para fines perseguidos por la normativa de igualdad salarial
desplegada en Perú.
This article aims to highlight that even though labor regulations on pay equity have been implemented in Peru, disparities persist. To this end, it reviews supranational labor regulations on pay equity between men and women, in addition to national regulations. For this purpose, it presents some characteristics of the composition of the Peruvian labor market in the private sector, reviews the level of compliance in this sector, and finally analyzes some of the possible causes of noncompliance. In light of the possible causes of non-compliance, it reviews international experiences regarding the implementation of pay equity regulations at the regional level – cases of Argentina and Chile, and at the European level. Among the various tools used by the countries mentioned in the article to achieve the goals of pay equity regulations for work of equal value, the one used by Spain stands out: The Pay Equity Plan, which constitutes a programmatic measure for closing the wage gap.
