Rumbo a la eficacia del Estado de Cosas Inconstitucional: la necesidad de implementar mecanismos de accountability basados en criterios de Buen Gobierno para garantizar la tutela de Derechos Fundamentales

Abstract

El artículo subraya la necesidad de implementar mecanismos de accountability basados en Buen Gobierno (BG) para asegurar que el Tribunal Constitucional (TC) a través de sus declaratorias de Estado de Cosas Inconstitucional (ECI) logre su propósito de proteger los derechos fundamentales (DD. FF.) En primer lugar se determina cuál el rol que tiene el TC en la protección de DD. FF. en el Estado Constitucional de Derecho (ECD) y se discute cómo bajo este rol garantista no solo supervisa la supremacía de la Constitución Política del Perú (CPP) sino que a su vez se permite declarar un ECI cuando detecta que existe una vulneración masiva, estructural y sistemática de DD. FF., por lo que en un marco de ECD y a la luz del BG se hace necesaria que el TC use esta técnica. Ahora bien cuando el TC declara estas medidas a través de un ECI también es importante que se adopten a la par mecanismos de accountability, es decir medidas de seguimiento y supervisión de las mismas para ver si esta técnica (ECI) es efectiva y que no se queden en simples declaratorias o pronunciamientos con buenas intenciones. Así, el presente artículo concluye que el ECI puede ser un mecanismo poderoso para corregir violaciones sistémicas de DD. FF., siempre y cuando se le proporcionen herramientas efectivas de accountability bajo estándares de BG para ver su seguimiento y efectividad real y así el TC siga cumpliendo su rol garante y de tutela de los DD. FF. y a la vez también monitorear y evaluar el cumplimiento de sus declaraciones.

This article highlights the need to implement accountability mechanisms based on Good Government (GG) to ensure that the Constitutional Court (CC) through its declarations of Unconstitutional State of Affairs (USOA) achieves its purpose of protecting fundamental rights (FF. RR.) Firstly, it determines what role the CC has in the protection of FF. RR. within the framework of the Constitutional Rule of Law (CRL), and it discusses how under this guaranteeing role it not only supervises the supremacy of the Political Constitution of Peru but at the same time it is allowed to declare an USOA when it detects that there is a massive structural and systematic violation of FF. RR., so in a framework of the CRL and in the light of GG it is necessary for the CC to use this technique. Now, when the CC declares these measures through an ECI, it is also important that accountability mechanisms are adopted at the same time, that is, monitoring and supervision measures to see if this technique (USOA) is effective and that it does not remain simple declarations or pronouncements with good intentions. Finally, this article concludes that the USOA can be a powerful mechanism to correct systemic violations of FF. RR., as long as it is provided with effective accountability tools under GG standards to see their monitoring and real effectiveness so that the CC continues to fulfill its mandate as a guarantor role as protector of FF. RR. and also monitor and evaluate compliance with its declarations.
