Resumen
El presente artículo aborda la figura del Grupo de Empresas en el Perú y su
vínculo con la noción de “empleador”, así como los efectos que dicha relación
puede generar respecto de los trabajadores. No obstante, esta figura carece de
una regulación normativa que delimite claramente sus responsabilidades,
derechos y/o consecuencias en las relaciones jurídicas que establece,
especialmente en el ámbito laboral. Esta ausencia ha dado lugar a diversas
interpretaciones sobre su tratamiento. Si bien el Poder Judicial ha intentado
resolver los conflictos surgidos entre los trabajadores y los Grupos de Empresas,
en la práctica persisten posturas disímiles que generan incertidumbre en torno a
los derechos laborales reclamados. En ese contexto, se vuelve imperiosa la
necesidad de una regulación específica que permita alcanzar uniformidad
jurisprudencial, seguridad jurídica y una adecuada aplicación del Derecho
Laboral.
This article examines the concept of the Group of Companies in Peru and its connection to the notion of the “employer,” as well as the legal effects this relationship may have on workers. Despite its relevance, this figure lacks specific legal regulation that clearly defines its responsibilities, rights, and/or the consequences it may generate within legal relationships—particularly in the labor sphere. The absence of such regulation has led to divergent interpretations regarding its legal treatment. Although the Judiciary has made efforts to address the disputes arising between workers and Groups of Companies, in practice, inconsistent positions persist, creating uncertainty around the labor rights being claimed. In this regard, the need for a specific regulation becomes imperative to achieve jurisprudential consistency, legal certainty, and the proper application of labor law.
