Abstract
El problema central abordado en esta investigación se centra en las deficiencias
y desafíos del proceso legal vinculado a la violencia familiar. Se destaca la falta
de estándares probatorios claros y la limitación del derecho a la contradicción
para los presuntos agresores, lo cual genera situaciones de vulnerabilidad y
posibles injusticias en la emisión de Medidas de Protección. El objetivo principal
de este trabajo es analizar críticamente el proceso legal actual, proponiendo
mejoras que aseguren un equilibrio justo entre la protección de las víctimas y los
derechos fundamentales de los denunciados. Se busca, específicamente, la
revisión y clarificación de estándares probatorios y de motivación para garantizar
un procedimiento más transparente y respetuoso del debido proceso,
contribuyendo así a una respuesta integral y adecuada a las necesidades de
quienes enfrentan situaciones de violencia familiar.
The central problem addressed in this research focuses on the deficiencies and challenges of the legal process linked to family violence. The lack of clear evidentiary standards and the limitation of the right to contradiction for alleged aggressors stands out, which generates situations of vulnerability and possible injustices in the issuance of Protective Measures. The main objective of this work is to critically analyze the current legal process, proposing improvements that ensure a fair balance between the protection of victims and the fundamental rights of those reported. Specifically, the review and clarification of evidentiary and motivation standards is sought to guarantee a more transparent and respectful procedure of due process, thus contributing to a comprehensive and appropriate response to the needs of those facing situations of family violence.
