Abstract
El presente artículo busca dar respuesta a cuáles son los alcances de la Fé
Pública Registral, quiénes se encuentran amparados ante dicha figura, si bien
es cierto que esta protege al adquirente que adquiere la propiedad como
consecuencia de una segunda transferencia, de buena fe y sin haber participado
en la primera transferencia que adolecía de defecto insubsanable, ¿es posible
que un acreedor hipotecarios se vea protegido por la Fé Pública Registral?
¿dicha protección es extensiva a otros derechos reales?,o, por lo contrario, ¿la
Fé Pública Registral solo se limita a ser aplicable para la protección de aquel que
ostenta un título de propiedad inscrito en registros públicos?, para ello se
requerirá realizar un análisis de los requisitos escenciales para constituirnos
dentro del supuesto de Fé Pública Registral y las posturas de la doctrina que
buscan dar respuesta a dicha disyuntiva.
This article seeks to respond to the scope of the Public Registry Faith, who are protected by suck figure, although, it is true that it protects the acquire who acquires the property as a consequence of a second transfer, in good faith and without having participated in the first transfer that had an irremediable defect, is it possible for a mortgagee to be protected by the Public Registry Faith? Is such protection extensive to other real rights? Or, on the contrary, is Public Faith in Registration only limited to be applicable for the protection of those who hold a property title registered in public registries? For this purpose, it will be necessary to analyze the essential requirements to constitute ourselves within the assumption of Public Faith in Registration and the positions of the doctrine that seek to give an answer to such disjunctive.
