Análisis y evaluación de la Ley de Transparencia y Acceso a la Información Pública en el II semestre 2012 del Gobierno Regional de Ucayali: aportes para mejorar su implementación y eficiencia de gestión

Abstract
La transparencia y el acceso a la información pública, constituyen
elementos fundamentales en la prevención y lucha contra la corrupción, por lo
que es muy importante revisar constantemente su proceso de implementación,
para fortalecerla en aras de constituir una sociedad honesta, responsable y
democráticamente sostenida, dentro de un orden social de respeto a la dignidad
y los derechos humanos.
El presente estudio de investigación tiene como objetivo de verificar,
analizar y evaluar la implementación de la ley de transparencia y acceso a la
información pública al Gobierno Regional de Ucayali, durante el II semestre del
2012, con la finalidad de proponer alternativas que contribuyan a su mejora y se
constituya en un instrumento de eficiencia en la gestión de dicha entidad del
Estado.
Este estudio nos permitió conocer, en términos de gestión social, de
cuánto era la transparencia de la información que se publicaba en su portal de
transparencia estándar (PTE); así como, hasta qué punto se venía permitiendo a
la población en solicitar información de la gestión regional. En ambos casos,
referente al contexto de competencia regional que incluye sus planes, políticas,
proyectos y programas de desarrollo económico y social.
La investigación fue desarrollada utilizando la metodología cualitativa,
bajo la forma de un estudio de caso; es decir, de manera empírica (explorativa,
descriptiva, explicativa).
El proceso de transparencia fue evaluado, analizando la cantidad de
información de la gestión gubernamental publicada virtualmente en el PTE, y en
qué medida ésta era actualizada. En cuanto al proceso del acceso a la
información, su evaluación fue determinada en relación a la aceptabilidad de las
solicitudes de acceso a la información, que la población requería a través del
portal virtual institucional (PVI).
Con el propósito de verificar la veracidad de la información recolectada y
determinar hasta qué punto la teoría se cristalizaba en la práctica para dar una
respuesta adecuada a las preguntas de investigación, se entrevistó a grupos
representativos de funcionarios del Gobierno Regional, representantes de las
organizaciones civiles y ciudadanos que visitaban esta institución pública,
utilizando una guía pre-elaborada.
Mediante la técnica de triangulación, se analizó y evaluó a profundidad los
datos obtenidos que conllevaron en determinar las conclusiones y
recomendaciones al proceso de implementación de la ley en estudio; así como
también, para que estas sean consideradas en la elección de instrumentos que
pudieran contribuir en la eficiencia de gestión de dicha entidad regional.
Concluyendo que el gobierno regional de Ucayali, presenta una
efectividad de transparencia del 60 % en la publicación de su administración en el
PTE; en cuanto al acceso a la información de su gestión, su efectividad fue
reflejada en un 0%. Resultados que, al haber sido contrastados con el análisis de
las entrevistas realizadas, podrían, muy bien, ser tomadas en cuenta para lograr
mejoras en la implementación y cumplimiento de la ley en cuestión.
Confiamos a que las conclusiones y recomendaciones derivadas del
presente estudio, puedan contribuir al logro de la eficiencia y efectividad en la
implementación de la ley de transparencia y acceso a la información pública, así
como, en la mejora continua de su gestión que indudablemente favorecerán al
fortalecimiento y la sostenibilidad del orden social de esta región. De tal manera,
que podría constituirse en una de las instituciones más transparentes al contar
con gran respaldo de confianza, por parte de la población de Ucayali, que por sus
derechos constitucionales y democráticos ahora exigen que sus representantes
y/o gobernantes sean honestos y sin ningún vestigio de corrupción que, como tal,
podría convertirse en una institución paradigmática para ser emulada por los
gestores sociales de los gobiernos regionales.
Transparency and access to public information are fundamental elements in the prevention and fight against corruption, so it is very important to constantly review its implementation process to strengthen it in order to build an honest, responsible and, democratically sustainable society within a social order of respect for dignity and human rights. This research aims to verify, analyze and evaluate the implementation of the law of transparency and access to public information to the Regional Government of Ucayali, during the second half of 2012, in order to propose alternatives that contribute to its improvement and become an instrument of efficiency in the management of this government entity. This study allowed us to know, in terms of social management, how much was the transparency of the information published in its Standard Transparency Portal (STP); as well as, to what extent the population was allowed to requested information on regional management. Both cases, referred to the context of regional competition that includes its plans, policies, projects and, economic and social development programs. The investigation was developed using the qualitative methodology, in the form of a case study; that is, empirically (exploratory, descriptive, explanatory). The transparency process was evaluated, analyzing the amount of government management information published virtually in the STP., and to what extent it was being updated. Regarding the process of access to information, its evaluation was determined based on the acceptability of requests for access to information, which the population required through Government Web Page (GWP). With the purpose of verifying the truthfulness of the information collected and determine to what extent the theory was being crystallized in practice to give an adequate response to the research questions; representative groups of regional government officials, representatives of civil organizations and citizens who visited this public institution, were interviewed using a previously prepared guide. Using the triangulation technique, the data obtained were analyzed and evaluated in depth to determine the conclusions and recommendations for the implementation of the law under study; as well as, so that they can be considered in the choice of instruments that could contribute to the efficiency of the management of this regional entity. Concluding that the Regional Government of Ucayali, presents a transparency effectiveness of 60% in the publication of its administration on the STP. Regarding the access to the information of its management, the effectiveness was reflected at 0%. Results that, having been contrasted with the analysis of the interviews conducted, could, very well, be taken into account to achieve improvements in the implementation and compliance with the law in question. We trust that the conclusions and recommendations derived from this study, can contribute to the achievement of efficiency and effectiveness in the implementation of the law of transparency and access to public information, as well as, in the continuous improvement of its management that will undoubtedly favor the strengthening and sustainability of the social order of that region. In this way, it could become one of the most transparent institutions and have a great support of confidence from the population of Ucayali, who for their constitutional and democratic rights now demand that their representatives and/or governors be honest and without vestiges of corruption, which, as such, could converted in a paradigmatic institution to be emulated by the social managers of regional governments.
