Abstract
El presente trabajo busca analizar las cláusulas abusivas en los contratos de
seguro de servicio financieros de tarjeta de crédito y débito, entendiendo que la
suscripción del contrato de éstas últimas implica, como base en el deber de
idoneidad, una responsabilidad mayor de la entidad financiera que no puede
ser reemplazada por el contrato de seguro.
Asimismo, se analiza cuál es la postura del Indecopi y la Superintendencia de
Banca, Seguros y AFP frente a las cláusulas abusivas, pasando sobre algunas
resoluciones que hablar del tema.
Finalmente, analizamos algunos ejemplos de contratos financieras de éste tipo
de seguros y encontramos ciertas situaciones que parecen calificar como
cláusulas abusivas para la activación de los mismos.
This paper seeks to analyze the abusive clauses in credit and debit card financial service insurance contracts, understanding that the subscription of the contract of the latter implies, as a basis on the duty of suitability, a greater responsibility of the financial institution that cannot be replaced by the insurance contract. Likewise, the position of Indecopi and the Superintendencia de Banca, Seguros y AFP in the face of abusive clauses is analyzed, passing on some resolutions to talk about the subject. Finally, we analyse some examples of financial contracts for this type of insurance and find certain situations that seem to qualify as abusive clauses for their activation.
