Abstract
El presente trabajo tiene como objetivo analizar la vigencia de los Planes de Adecuación y
Manejo Ambiental (PAMA) en el sub sector hidrocarburos, el cual se ha constituido en el
principal instrumento de gestión ambiental en proyectos de explotación hidrocarburífera.
Para ello, se realiza un breve recuento de las principales disposiciones del marco legal que
ha regulado la implementación del PAMA, desde el D.S. N° 046-93-EM hasta el actual D.S.
N°039-2014-EM, bajo cuya vigencia se han regulado instrumentos correctivos
complementarios al PAMA, tales como el Plan Ambiental Complementario, el Plan de
Manejo Ambiental, el Plan Ambiental Detallado y el Plan de Adecuación Ambiental, que
han posibilitado su subsistencia hasta la actualidad.
Asimismo, se analiza la vigencia del PAMA en el sub sector hidrocarburos a la luz del
Principio de Indivisibilidad y del Principio de Jerarquía de la Mitigación, planteándose como
propuesta que el procedimiento de actualización del PAMA es una obligación a cargo de los
titulares de las actividades hidrocarburiferas, en el que la evaluación de los impactos
ambientales generados por las ampliaciones en componentes principales, auxiliares así como
de las medidas de rehabilitación y remediación gestionadas por sus instrumentos
complementarios se realice bajo un enfoque de integralidad.
The objective of this paper is to analyze the validity of the Environmental Adaptation and Management Plans (PAMA by its acronym in Spanish) in the oil subsector, which has become the main environmental management instrument in oil exploitation projects. For this, a brief recount is made of the main provisions of the peruvian legal framework that has regulated the implementation of the PAMA, from D.S. N° 046-93-EM to the current D.S. N°039-2014-EM, under whose validity complementary corrective instruments to the PAMA have been regulated, such as the Plan Ambiental Complementario, the Plan de Manejo Ambiental, the Plan Ambiental Detallado and the Plan de Adecuación Ambiental, which have enabled their subsistence until the present. Likewise, the validity of the PAMA in the oil subsector is analyzed in light of the Principle of Indivisibility and the Mitigation Hierarchy Principle, formulating as a proposal that the PAMA update procedure is an obligation in charge of the owners of the oil exploitation activity, in which the evaluation of the environmental impacts generated by the extensions in main and auxiliary components, as well as the rehabilitation and remediation measures managed by their complementary instruments, is carried out under a comprehensively approach.
