La presentación electrónica de medidas cautelares en los Juzgados Civiles del Cusco: análisis de desafíos, oportunidades y el impacto de las políticas institucionales

Abstract

La implementación de la presentación electrónica de medidas cautelares en los Juzgados Civiles del Cusco enfrenta un desafío importante: la lenta adopción de herramientas tecnológicas diseñadas para agilizar la administración de justicia. A pesar de contar con un marco normativo sólido, como la Resolución N° 120- 2019-SUNARP/SN y el uso de plataformas como SIJ y SID-SUNARP, persisten problemas relacionados con la conectividad, la infraestructura tecnológica y la capacitación de los operadores judiciales. Estos factores limitan el acceso a una tutela judicial urgente, un derecho fundamental que busca garantizar la protección efectiva y rápida de los derechos de los litigantes judiciales. El estudio aborda la interacción entre las políticas institucionales de la Corte Superior de Justicia de Cusco y las innovaciones digitales. Destaca que, aunque estas herramientas han demostrado su efectividad en otras jurisdicciones como Argentina, Chile y Colombia, en los juzgados civiles y mixtos del Cusco su implementación es limitada y enfrenta barreras operativas. Como conclusión, el documento subraya la importancia de alinear la normativa con una ejecución efectiva que contemple mejoras en infraestructura, formación continua, y un monitoreo constante. Propuestas como automatizar notificaciones a los litigantes y establecer sistemas de soporte técnico pueden cerrar la brecha entre el potencial de las tecnologías y su impacto real en la justicia. Este análisis invita a reflexionar sobre cómo una adecuada modernización puede transformar el acceso a la justicia en Cusco, marcando un camino hacia una administración judicial más eficiente y transparente.The implementation of electronic submission of precautionary measures in the Civil Courts of Cusco faces a significant challenge: the slow adoption of technological tools designed to streamline judicial administration.
