Eficacia del Principio de igualdad de remuneración entre mujer y varón por un trabajo de igual valor en el Perú

Abstract
En el año 2017 se aprobó la Ley Nro 30709 con la cual se buscaba la eliminación
de las situaciones de discriminación remunerativa entre mujeres y hombres
considerando la aplicación y eficacia en materia remunerativa del principio de
igual remuneración entre mujer y varón por trabajo de igual valor previsto en el
Convenio 100 de la OIT. A dicha fecha los indicadores estadísticos mostraban
que en el Perú la brecha salarial entre hombres y mujeres bordeaba el 29.3%,
un nivel muy alto; por lo que, la finalidad de dicha norma era la progresiva
reducción de los niveles de brecha salarial existentes en nuestro país; sin
embargo, en el año 2021 la brecha salarial se ubicó en un 25.9%; por lo que, a
través del presente documento se busca analizar si la Ley Nro. 30709 y la
metodología de la misma, que establece la determinación de cuadros de
categorías y funciones y respecto de los mismos la aplicación del sistema de
puntuación por criterios objetivos señalados en la norma, es eficaz para el logro
de la eliminación de la discriminación salarial y eficacia del principio de igual
remuneración entre mujer y varón por trabajo de igual valor. Al respecto
consideramos que la metodología señalada no es adecuada para eliminar la
discriminación salarial y lograr la eficacia del principio de igual remuneración
entre mujer y varón por trabajo de igual valor, consideramos que el camino
adecuado es aplicar la metodología recomendada por la OIT.
In 2017, Law 30709 was approved, with which the elimination of situations of remuneration discrimination between women and men was sought, considering the application and effectiveness in remuneration matters of the principle of equal remuneration between women and men for work of equal value provided for in ILO Convention 100. On that date, statistical indicators showed that in Peru the wage gap between men and women was around 29.3%, a very high level. In this regard, we consider that the indicated methodology is not adequate to eliminate wage discrimination and achieve the effectiveness of the principle of equal remuneration between women and men for work of equal value, we consider that the appropriate path is to apply the methodology recommended by the ILO.
