Abstract
La presente investigación busca solucionar el problema del limitado acceso a la
justicia que tienen las madres vulnerables que demandan una pensión de alimentos.
Para ello, proponemos implementar el uso de la inteligencia artificial (IA) mediante
el aplicativo digital Yanasaa, palabra quechua que significa 'amigable'. Esta
propuesta de innovación pretende potenciar una serie de iniciativas realizadas por
el Poder Judicial peruano en el marco de la Política Nacional de Transformación
Digital al 2030 para dar celeridad a los diversos procesos judiciales y así combatir
la recarga procesal. Sobre el tema que compete a nuestra propuesta, desde marzo
de 2022 diversas Cortes Superiores de Justicia implementaron una plataforma web
para que las madres puedan realizar sus respectivas denuncias por alimentos sin la
intervención de un abogado; sin embargo, no se consideraron algunas limitaciones
tecnológicas de las justiciables, como por ejemplo, que las madres en extrema
pobreza no cuentan con una computadora o laptop en casa, tampoco tienen el
servicio de internet y, fundamentalmente, no están alfabetizadas en la cultura digital.
Por ello, proponemos una herramienta electrónica que tiene articulado un programa
de IA a un smartphone, que servirá como canal de atención para las usuarias en
extrema pobreza que realicen un proceso judicial en materia de alimentos. Este
prototipo, que cuenta con viabilidad, deseabilidad y factibilidad, busca ser una
primera herramienta que, a través del uso de la IA, se convierta en un medio
alternativo y eficaz para ayudar a las madres en condición de vulnerabilidad del
distrito de Carabayllo.
The present research seeks to solve the problem of limited access to justice for vulnerable mothers claiming child support. For this purpose, we suggest implementing the use of artificial intelligence (AI) through the digital application Yanasaa, a Quechua word that means 'friendly'. This innovation proposal aims to enhance a series of initiatives carried out by the Peruvian Judiciary in the framework of e-government to speed up the various judicial processes and thus combat procedural overload. On the issue that concerns our proposal, since March 2022, several High Courts of Justice have implemented a web platform so that mothers can make their respective maintenance claims without the intervention of a lawyer; however, some of the technological limitations of the women in court were not considered, such as the fact that mothers in extreme poverty do not have a computer or laptop at home, nor do they have internet service and, fundamentally, they are not digitally literate. For this reason, we propose an electronic tool that has an AI programme linked to a smartphone, which will serve as a channel of attention for users in extreme poverty who carry out a judicial process in matters of child support. This prototype, which has viability, desirability and feasibility, seeks to be a first tool that, through the use of AI, becomes an alternative and effective means to help mothers in vulnerable conditions in the district of Carabayllo.
