Saneamiento físico legal de inmuebles policiales: Afectación a la infraestructura y calidad del servicio público que brinda La PNP

Abstract

La Policía Nacional del Perú (PNP), tiene por finalidad Constitucional prevenir, investigar y combatir el delito, garantizando la seguridad ciudadana mediante la función policial materializada en el “servicio policial” como actividad de servicio y protección a la sociedad (MININTER, 2018), siendo de prevención (orientación y acercamiento, recepción de denuncias, constataciones, etc) y de represión (investigación de delitos, protección de víctimas y combate a la delincuencia) (PNP, 2020). A nivel nacional se tiene 1,310 Comisarías básicas tipo A, B, C y D (126 en Lima metropolitana) y 185 comisarías especializadas (INEI, 2017), y 74 DEPINCRIS PNP (26 en Lima metropolitana) (Defensoría del Pueblo, 2009), constituyéndose ambas dependencias (infraestructura) en rostro público de la PNP y núcleo esencial en la atención de calidad al ciudadano. Un ambiente de trabajo con buena infraestructura promueve eficiencia y motivación, en sí mismo y como organización (PNP, 2021), sino producirá inseguridad y desconfianza. El aumento de la percepción de inseguridad en 85.5%, la victimización en 26.5% (Informe INEI, 2025) y disminución de la confianza ciudadana en la PNP en 18.9% (MININTER, 2024), sumado a las exigencias normativas de la ley Nº 27658, Ley Marco de Modernización de la Gestión del Estado, que promociona un nuevo enfoque basado en la demanda o satisfacción de las necesidades del ciudadano (PCM, 2015), denotan que la ciudadanía percibe que el servicio policial, en Comisarías y DEPINCRIS, no es el más adecuado, por lo que se requiere respuestas inmediatas de la institución policial. Las Comisarías y DEPINCRIS provenientes de ex-instituciones policiales (GC, PIP y GRP), donaciones de bienes nacionales, sesión de uso, entre otros, causan dificultad al carecer de saneamiento físico legal (SFL) e inscripción en SUNARP a nombre de la PNP o MININTER, impidiendo la inversión pública y privada en la construcción de nuevos locales, mejoras y mantenimiento adecuado (VIVIENDA, 2021). El SFL del predio es requisito importante en la formulación de expedientes técnicos para inversión y construcción de Comisarías (PNP, 2021), no obstante, afecta la mejora de infraestructura y la calidad del servicio público que brinda la PNP a la colectividad.

The Constitutional purpose of the Peruvian National Police (PNP) is to prevent, investigate, and combat crime, guaranteeing citizen security through the police function embodied in the "police service" as an activity of service and protection to society (PNP, 2020). These functions are prevention (guidance and outreach, receiving complaints, verifications, etc.) and repression (investigation of crimes, protection of victims, and combating crime) (PNP, 2004). Nationwide, there are 1,310 basic police stations, types A, B, C, and D (126 in metropolitan Lima) and 185 specialized police stations (INEI, 2017), and 74 PNP DEPINCRIS (26 in metropolitan Lima) (Defensoría del Pueblo, 2009). Both units (infrastructure) constitute the public face of the PNP and an essential core for providing quality citizen service. A work environment with good infrastructure promotes efficiency and motivation, both in itself and as an organization (PNP, 2021); otherwise, it will produce insecurity and mistrust. The increase in the perception of insecurity by 85.5%, victimization by 26.5% (INEI 2025), and a decrease in citizen trust in the PNP by 18.9% (MININTER, 2024), coupled with the regulatory requirements of Law No. 27658, the Framework Law for the Modernization of State Management, which promotes a new approach based on citizen demand or the satisfaction of needs (PCM, 2015), indicate that citizens perceive that police service, in police stations and DEPINCRIS, is not the most adequate, thus requiring immediate responses from the police institution. Police stations and DEPINCRIS (Department of Public Prosecutors' Deeds) originating from former police institutions (GC, PIP, and GRP), donations of national assets, and use permits, among others, cause difficulties due to the lack of legal physical sanitation (SFL) and registration with SUNARP in the name of the PNP or MININTER, impeding public and private investment in the construction of new premises, improvements, and adequate maintenance (VIVIENDA, 2021). The SFL (Department of Public Prosecutors' Deeds) of the property is an important requirement in the preparation of technical files for investment and construction of police stations (PNP, 2021). However, it affects infrastructure improvements and the quality of public service provided by the PNP to the community.
