Creación de un Departamento Especializado para resolver el problema del saneamiento físico legal de las CPNP de Lima Metropolitana, 2023

Abstract
El Saneamiento Físico Legal (SFL) de las Comisarias PNP es una vieja deuda en el
campo de la infraestructura policial, expresado en el no registro formal de los terrenos y
locales policiales en los registros de propiedad correspondientes. En este proyecto de
innovación hemos tomado en cuenta el SFL de las comisarías, que en su mayoría se han
creado a partir de la entrega de las comunidades o centros poblados de locales o predios a
la Policía Nacional del Perú (PNP) para el funcionamiento de una comisaría,
procedimiento que desde sus inicios administrativos tuvo el vicio de no contar con la
documentación adecuada propia de una propiedad legal. Las Comisarias de Lima
Metropolitana son un total de 111. De esta cantidad, 59 (53.2%) cuentan con SFL y las
52 (46.8%) dependencias restantes no cuentan con SFL.
El Proyecto ha tomado en cuenta como experiencias nacionales el SFL de Predios
Urbanos Desarrollado por la Dirección Regional de Vivienda y Construcción del Cusco y
el SFL de las instituciones educativas de Jicamarca de Lima. Como experiencias
internacionales se ha tomado en cuenta la experiencia de Villavicencio, en Nueva
Colombia II, Bogotá, y el caso del Asentamiento Humano Altos de Israel en Barranca
Bermejo, Santander, Colombia, en el 2018.
El problema original fue definido como la “carencia del SFL de las Comisarias PNP de
Lima Metropolitana”, siendo sus causas las siguientes: a) la instalación improvisada de
locales de la PNP por necesidad del servicio policial, b) la escasa coordinación e
iniciativa por los funcionarios encargados de resolver el problema, c) la inexistencia de
un Departamento especializado con personal profesional y técnico experto en SFL, d) el
escaso presupuesto para el equipamiento de unidades de SFL.
Como consecuencia de lo anterior, se han originado los efectos siguientes: a) inadecuada
infraestructura de las comisarias, b) imposibilidad legal para proyectos de mantenimiento y remodelación de comisarías y c) afectación de la calidad y cantidad de los servicios
policiales.
Como causa prioritaria se seleccionó la inexistencia de un Departamento especializado
con personal profesional y técnico experto en SFL, que se convirtió en el desafío
priorizado. El Departamento estará dentro de la División de Infraestructura PNP y se
dedicará exclusivamente a las gestiones administrativas y operativas del SFL de las
unidades policiales. Se proyecta que el nuevo Departamento tenga acceso directo al Jefe
de la División y plantee las mejores acciones para el SFL, priorizando los trámites y
gestiones que conlleven al SFL. Asimismo, que sea dotado de personal profesional y
tecnología relacionada al quehacer funcional.
Para el testeo de la innovación, luego de plantear la solución de baja resolución, se
realizaron entrevistas al personal policial, que conjuntamente con las fichas de resumen
bibliográfico y la consulta de textos académicos, configuraron la solución final, la
creación de un Departamento en la DIVINFRA PNP, que se dedique exclusivamente a las
funciones del saneamiento de los locales policiales, con el objetivo de ser beneficiado
con los Proyectos de Inversión, para mejorar la infraestructura de las comisarias, y
consiguientemente brindar un mejor servicio a la comunidad.
The Physical-Legal Sanitation (SFL) of the PNP Police Stations is an old debt of the police infrastructure, consisting of the non-registration of police stations in certain territorial jurisdictions. In this innovation project we are going to take into account the SFL of police stations, which have been installed due to the handing over by communities or population centers of premises or land to the State for the operation of a police station, a procedure that from its administrative beginnings did not have the proper documentation to regularize the legal ownership. Of this number, 59 (53.2%) have an SFL and the remaining 52 (46.8%) do not have an SFL. The Project has taken into account as national experiences the SFL of urban properties developed by the Regional Directorate of Housing and Construction of Cusco and the SFL of the educational institutions of Jicamarca Anexo 8, Lima. As international experiences, the design of a guide for the sanitation of private property in Villavicencio, in Nueva Colombia II, Bogota, and the diagnosis and legalization of the Altos de Israel Human Settlement in Barranca Bermejo, Santander, Colombia, in 2018 have been taken into account. The original problem was defined as the "lack of the SFL of the PNP Police Stations in Metropolitan Lima, being its causes the following: a) the improvised installation of PNP premises due to the need of the police service, b) the scarce coordination and initiative of the officers in charge of solving the problem, c) the inexistence of a specialized department with professional and technical personnel expert in SFL, d) scarce budget for the equipment of SFL units. As a consequence of the above, we have the following effects: a) inadequate infrastructure of police stations, b) legal impossibility for maintenance and remodeling projects of police stations, and c) affectation of the quality and quantity of police services. The non-existence of a specialized department with professional and technical personnel with expertise in SFS was selected as a priority cause, which became the prioritized challenge. The Department will be part of the PNP Infrastructure Division and will be dedicated exclusively to the administrative and operational management of the SFL of police units. It is planned that the new Department will have direct access to the Chief of the Division and will propose the best actions for the SFL, prioritizing the procedures and steps that lead to the SFL. It is also planned that it will be staffed with professional personnel and technology related to its functional tasks. For the testing of the innovation, after proposing the low resolution solution, interviews were conducted with police personnel, which together with the bibliographic summary sheets and the consultation of academic texts, configured the final solution, the creation of a Department in the DIVINFRA PNP, which is dedicated exclusively to the functions of the sanitation of police premises, with the objective of benefiting from the Investment Projects, to improve the infrastructure of the police stations, and consequently provide a better service to the community.
