Abstract
El presente trabajo académico explora la forma en que las empresas de seguros
evalúan los términos de las exclusiones a la luz del principio de buena fe en los
contratos de seguros, resaltando su papel crucial para garantizar la equidad
entre las partes involucradas. A fin de lograr dicho objetivo, se analizarán las
consecuencias jurídicas tanto de la reticencia y declaraciones inexactas, así
como de la interpretación dada por la Sala Especializada en Protección al
Consumidor del Indecopi respecto a las exclusiones con terminaciones
ambiguas. Ello nos permitirá evaluar si cabe sancionar con nulidad aquellas
cláusulas imprecisas que son interpretadas de mala fe por las aseguradoras en
desmedro de los intereses de los consumidores. Como resultado, se busca
evidenciar que tanto las empresas de seguros como los contratante y/o
asegurados deben comportarse con transparencia, sinceridad y lealtad durante
todas las etapas del contrato. En la misma línea, una cuestión clave que
analizaremos es el consentimiento informado y su estrecha vinculación con el
alcance de las exclusiones. En virtud de ello, se propone que las empresas de
seguros asuman un compromiso más estricto en cuanto a la información y la
comunicación se trata. Por ello, se brindarán recomendaciones para las
aseguradoras a fin de que adopten prácticas más transparentes y diligentes para
garantizar que los términos técnicos sean fácilmente comprensibles por los
contratantes y/o asegurados.
This paper addresses the way in which insurance companies evaluate the terms of exclusions in light of the principle of good faith in insurance contracts, highlighting its crucial role in ensuring fairness between the parties involved. To achieve this objective, the legal consequences of both reticence and inaccurate statements will be analyzed, as well as the interpretation given by the Sala Especializada en Protección al Consumidor del Indecopi regarding exclusions with ambiguous endings. This will allow us to evaluate if it’s possible to sanction with nullity those imprecise or ambiguous clauses, that are interpreted in bad faith by insurers to the detriment of the interests of consumers. As a result, we seek to demonstrate that both, insurance companies and contracting parties and/or insured parties, must behave with transparency, sincerity and loyalty during all stages of the contract. In that sense, a key issue that we will analyze is informed consent and its close connection with the scope of exclusions. Therefore, it’s proposed that insurance companies assume a stricter commitment in terms of information and communication. In addition, recommendations will therefore be provided for insurers to adopt more transparent and diligent practices to ensure that technical terms are easily understood by policyholders and/or insureds.
