La prohibición de tenencia y uso de armas nucleares en el Derecho Internacional consuetudinario americano y su implicancia en el derecho a la vida, a la salud y al medio ambiente

Resumen
La prohibición de la tenencia y uso de las armas nucleares actualmente no se
encuentran reconocidas oficialmente en la costumbre universal, sobre todo por
la postura de los nueve Estados nucleares. No obstante, en razón del Tratado
de No Proliferación de Armas Nucleares (1970), el Tratado de Prohibición de
Armas Nucleares (2017), así como la postura actualizada de los Estados ante
las resoluciones de Asamblea General, entre otros instrumentos, se podría
considerar la existencia de una costumbre regional para los Estados americanos
respecto a dichas prohibiciones. En ese sentido, se procederá a realizar el
análisis de esta fuente del derecho internacional, considerando como base
esencial derechos interdependiente e indivisibles como lo son el derecho a la
vida, a la salud y al medio ambiente.
The prohibition of the possession and use of nuclear weapons is currently not officially recognized in universal custom, especially due to the position of the nine nuclear States. However, due to the Treaty on the Non-Proliferation of Nuclear Weapons (1970), the Treaty on the Prohibition of Nuclear Weapons (2017), as well as the updated position of the States regarding the resolutions of the General Assembly, among other instruments, currently, the existence of a regional custom for the American States could be considered. In this sense, the analysis will be carried out with respect to this source of international law, considering as an essential basis interdependent and indivisible rights such as the right to life, health and the environment.
