Resumen
La presente investigación procuró brindar una solución -o un intento de esta- a
las constantes interrogantes derivadas del análisis probatorio del fenómeno
jurídico de “buena fe” en casos de fe pública registral. De este modo, en primer
lugar, se abordó una descripción del requisito de buena fe para continuar con un
análisis de esta como medio probatorio. Seguidamente, se relataron casos
típicos y atípicos que describe la problemática actual al respecto y a los diversos
pronunciamientos. Finalmente, se propuso un bosquejo de solución al respecto,
con el propósito de brindar un estándar que dote de seguridad jurídica a las
personas inmersas en un proceso en el que su propiedad pueda verse afectada
o beneficiada al amparo del principio de fe pública registral.
The present research sought to provide a solution —or at least an attempt thereof— to the recurring questions arising from the evidentiary analysis of the legal notion of “good faith” within the framework of public registry faith. Accordingly, the study first presented a descriptive examination of the requirement of good faith, followed by an analysis of its function and treatment as a means of proof. Subsequently, both typical and atypical cases illustrating the current complexities of this issue were discussed, along with the various judicial and doctrinal pronouncements addressing it. Finally, the research proposed a preliminary framework of solution aimed at establishing a standard capable of ensuring legal certainty for individuals involved in proceedings in which their property rights may be affected or benefited under the principle of public registry faith.
