Fiscalización del correcto uso de las herramientas de trabajo otorgados al teletrabajador en el teletrabajo

Abstract

El presente trabajo tiene como objetivo analizar los límites del poder de fiscalización del empleador en el teletrabajo, especialmente cuando las actividades o las jornadas laborales se desarrollar fuera de su esfera de fiscalización directa. Para estos efectos, se ha estructurado el artículo en dos partes. En la primera parte, se examina la normativa legal laboral del Perú sobre el teletrabajo. Si bien, se busca regular el teletrabajo como una modalidad especial de prestación de servicios, es preciso preguntarnos si los empleadores peruanos están preparados para fiscalizar el correcto uso de las herramientas de trabajo otorgadas a los teletrabajadores en el teletrabajo. En la segunda parte, se analiza el poder de fiscalización del empleador, su regulación y los alcances de la vigilancia electrónica, a fin de evitar la vulneración de los derechos fundamentales de los teletrabajadores. Finalmente, se realiza un análisis de los límites a la fiscalización del empleador en el marco del teletrabajo. Se explora al juicio de ponderación como mecanismo para evitar posibles transgresiones a derechos fundamentales de los trabajadores, garantizando una aplicación correcta de los principios y normas jurídicas laborales.

The purpose of this paper is to analyze the limits of the employer's control power in teleworking, especially when the activities or working hours are developed outside the employer's direct sphere of control. For this aim, the article has been structured in three parts. In the first part, it examines the Peruvian labor law on teleworking. Although it seeks to regulate teleworking as a special mode of service provision, it is necessary to ask whether Peruvian employers are prepared to monitor the proper use of work tools granted to teleworkers in teleworking. In the second part, we analyze the power of control of the employer, its regulation and the scope of electronic surveillance, in order to avoid the violation of the fundamental rights of teleworkers. Finally, in the last part, an analysis of the limits to the control of the employer in the framework of teleworking is made. It explores the judgment of weighting as a mechanism to avoid possible transgressions to fundamental rights of workers, ensuring a correct application of the principles and legal labor standards.
