El incumplimiento de obligaciones no esenciales como causa de resolución contractual

Resumen
El presente trabajo de investigación comprende el análisis de la figura de la
resolución del contrato regulado por la normativa de contrataciones del Estado,
para lo cual se identificaron una serie de problemáticas contenidas en la Ley
N° 32069, Ley General de Contrataciones Públicas y en sus normas anteriores.
Analizando las particularidades contenidas en la normativa de contrataciones del
Estado, se apreció problemas evidenciados en los laudos arbitrales, por cuanto
pese a que han sido fundamentados en una misma base legal, los árbitros han
tenido posiciones discordantes, puesto que unos han considerado la gravedad
del incumplimiento como presupuesto para el ejercicio del remedio resolutorio,
mientras que otros han considerado que basta que se incumpla cualquier
obligación contractual, sin determinar la gravedad del incumplimiento de la
obligación.
Los objetivos propuestos frente a ello son, la aplicación supletoria del Código
Civil, en los contratos bajo la normativa de contrataciones del Estado, a efectos
de que a través de sus figuras jurídicas como el abuso del derecho y la buena fe
contractual, se establezcan parámetros jurídicos para evitar la resolución de los
contratos por parte de las Entidades ante el incumplimiento de cualquier
obligación que no revista gravedad, y con ello se pueda continuar con la
ejecución del contrato, protegiendo su operación económica y pueda cumplir su
finalidad, que es proveer los bienes, servicios y obras de forma oportuna en
beneficio de la colectividad.
This research paper includes an analysis of the concept of contract termination regulated by state procurement regulations. A series of issues contained in Law No. 32069, the General Law on Public Procurement, and its predecessor regulations were identified. Analyzing the specifics contained in state procurement regulations, problems were identified in the arbitration awards. Despite the fact that they have been based on the same legal basis, the arbitrators have taken differing positions. Some have considered the seriousness of the breach as a prerequisite for exercising the remedy, while others have considered that a breach of any contractual obligation is sufficient, without determining the seriousness of the breach. The proposed objectives are the supplementary application of the Civil Code to contracts under state procurement regulations. This is done through legal concepts such as abuse of rights and contractual good faith. This establishes legal parameters to prevent entities from terminating contracts in the event of non-compliance with any non-serious obligation. This allows the contract to continue to be executed, protecting its economic operation and fulfilling its purpose, which is to provide goods, services, and works in a timely manner for the benefit of the community.
