Deconstrucción de los conceptos de Bienestar Animal y Sufrimiento Innecesario Animal en el sistema jurídico peruano

Abstract

Cada vez es más notoria la preocupación por la protección de los animales y, en el ámbito jurídico se pueden identificar conceptos como Bienestar Animal y Sufrimiento Innecesario Animal. No obstante, en diferentes ordenamientos jurídicos del mundo se aplican e incluyen estos términos de diversas maneras. Por lo tanto, se pueden identificar diferentes interrogantes con relación a garantizar estos términos mediante la regulación jurídica de los animales en nuestro país. Por ejemplo, ¿considerar a los animales como sujetos de derechos? ¿otorgar a estos seres vivos derechos fundamentales? ¿prohibir las actividades que usan animales por el hecho que el ser vivo presenta lesiones o muere? En este artículo jurídico se busca abarcar estos dos conceptos fundamentales para el desarrollo jurídico de los animales en nuestro país. Cabe mencionar que, por temas de extensión de dicha investigación, se hará énfasis en la regulación de animales de compañía y animales de granja. De esta manera, se podrá (i) identificar los aspectos y las características más relevantes de dichos términos, (ii) identificar cómo se ve reflejado el marco general de estos términos en diferentes documentos normativos y jurisprudencia, y (iii) establecer recomendaciones para garantizar una efectiva protección de estos animales en diferente normativa específica.

Concern for the protection of animals is becoming more and more notorious and, in the legal field, concepts such as Animal Welfare and Unnecessary Animal Suffering can be identified. However, in different legal systems around the world these terms are applied and included in different ways. Therefore, different questions can be identified in relation to guaranteeing these terms through the legal regulation of animals in our country. For example, to consider animals as subjects of rights? to grant these living beings fundamental rights? to prohibit activities that use animals due to the fact that the living being is injured or dies? This legal article seeks to cover these two fundamental concepts for the legal development of animals in our country. It is worth mentioning that, due to the extension of this research, emphasis will be made on the regulation of companion animals and farm animals. In this way, it will be possible to (i) identify the most relevant aspects and characteristics of these terms, (ii) identify how the general framework of these terms is reflected in different regulatory documents and jurisprudence, and (iii) establish recommendations to guarantee an effective protection of these animals in different specific regulations.
