Abstract
El problema principal que se analiza en el presente trabajo de investigación se
encuentra a vinculado a conocer si con el marco normativo vigente en materia de
Residuos de Aparatos Eléctricos y Electrónicos (RAEE) ha está logrando alcanzar
superar las deficiencias del primer marco normativo en la materia y, si se está logrando
alcanzar la finalidad principal del manejo de los RAEE que es la valorización de los
residuos. Para ello, se analizará cuáles son los diferentes aspectos que condicionan
el no poder alcanzar la finalidad última que es la valorización, mediante el análisis de
tres casos prácticos.
Entre los aspectos que observamos tenemos que, si bien le regulación vigente ha
superado las deficiencias normativas del Reglamento anterior, a la fecha, el
desenvolvimiento de los Sistemas de Manejo de Manejo de RAEE y la aplicación de
sus respectivos Planes de Manejo de RAEE no garantizan que finalmente haya un
avance significativo en términos de recolección de RAEE, con lo cual, no se puede
garantizar que el gran grueso de estos residuos sólidos sean valorizados.
Frente a esa situación, se identifican las mejoras que se pueden realizar en el propio
Sistema de Manejo de RAEE, como responsabilidad del productor, en conexión con
las innovaciones que el MINAM debe ejecutar para superar los aspectos que impiden
alcanzar finalmente que la recolección de RAEE y su valorización sea significativa.
The main problem to be analyzed in this research work is linked to know if the current regulatory framework on Waste Electrical and Electronic Equipment (WEEE) has managed to overcome the deficiencies of the first regulatory framework on the subject and if it is achieving the main purpose of WEEE management, which is the recovery of the waste. For this purpose, we will analyze the different aspects that condition the failure to achieve the ultimate goal of recovery, through the analysis of three practical cases. Among the aspects that we observe we have that, although the current regulation has overcome the normative deficiencies of the previous regulation, to date, the development of the WEEE Management Systems and the application of their respective WEEE Management Plans do not guarantee that there will finally be a significant advance in terms of WEEE collection, and therefore, it cannot be guaranteed that the great bulk of these solid wastes will be valorized. In view of this situation, the improvements that can be made in the WEEE Management System itself are identified, as the responsibility of the producer, in connection with the innovations that MINAM must implement to overcome the aspects that prevent the collection of WEEE and its valorization from being significant.
