Abstract
Esta investigación busca analizar las obligaciones internacionales derivadas de
la prohibición del genocidio, específicamente en el marco de la Convención de
las Naciones Unidas para la Prevención y la Sanción del Delito de Genocidio de
1948. Este análisis permitirá determinar si el Estado de Israel ha incurrido en
responsabilidad internacional por la presunta violación de los artículos I, II, III y
IV de dicha Convención. Para ello, se estudiarán los elementos constitutivos de
un ilícito internacional, identificando si las acciones atribuidas a Israel configuran
una transgresión al derecho internacional y, en consecuencia, una violación a las
normas imperativas (ius cogens) que protegen contra el genocidio.
El estudio se centrará en las exigencias impuestas por la Convención de 1948,
incluidas las obligaciones de prevención, sanción y reparación, así como en las
normas consuetudinarias y la jurisprudencia internacional relevante sobre la
materia, con el propósito de establecer un marco teórico sólido para evaluar la
responsabilidad de Israel, por los ataques a la población palestina en Gaza,
desde el 7 de octubre de 2023, hasta el 31 de mayo de 2024. Además, se
analizará si, al tratarse de una norma imperativa ius cogens, es posible la
aplicación de alguna exención de responsabilidad.
The present research aims to analyze the international obligations arising from the prohibition of genocide, specifically within the framework of the United Nations Convention on the Prevention and Punishment of the Crime of Genocide of 1948. This analysis will determine whether the State of Israel has incurred international responsibility for the alleged violation of Articles I, II, III, and IV of said Convention. To this end, the constitutive elements of an international wrongful act will be examined to identify whether the actions attributed to Israel constitute a breach of international law and, consequently, a violation of jus cogens norms that protect against genocide. The study will focus on the obligations imposed by the 1948 Convention, including prevention, punishment, and reparation, as well as on customary norms and relevant international jurisprudence, with the aim of establishing a solid theoretical framework to assess Israel's responsibility for the attacks on the Palestinian population in Gaza from October 7, 2023, to May 31, 2024. Additionally, it will evaluate whether, given the status of jus cogens as an imperative norm, the application of any exemption from responsibility is possible.
