Personalización y diferenciación del consentimiento informado: Adaptando la información a las necesidades de pacientes en intervenciones quirúrgicas estéticas y terapéuticas en Perú

Abstract

El trabajo analiza la personalización del consentimiento informado, destacando la importancia de adaptar la información a las necesidades específicas de pacientes sometidos a intervenciones quirúrgicas terapéuticas y estéticas en el Perú. Examina los conceptos y elementos del consentimiento informado, el deber de información, sus orígenes, y la evolución de la relación médico-paciente desde un enfoque paternalista hacia uno autonomista, enmarcándolos en principios bioéticos. El estudio enfatiza la necesidad de un estándar adecuado para el suministro de información, considerando las diferencias entre procedimientos terapéuticos y estéticos. Analiza cómo la doctrina y jurisprudencia comparada han abordado estas distinciones, señalando que el precedente en análisis no incorpora adecuadamente elementos clave, como la adaptación de la información a las características individuales del paciente o la elección de un estándar informativo claro. El informe critica la falta de un enfoque crítico y propositivo en la jurisprudencia para integrar estas necesidades, destacando su importancia para garantizar que el consentimiento informado sea una herramienta efectiva que respete los derechos del paciente y sea comprensible para el personal médico. Concluye subrayando la importancia de una reflexión continua que permita mejorar la práctica del consentimiento informado, asegurando su efectividad tanto en términos legales como éticos.

The paper analyzes the personalization and differentiation of informed consent, focusing on adapting the information to the specific needs and characteristics of patients undergoing therapeutic and aesthetic surgical interventions in Peru. The paper discusses the concept and elements of informed consent, the definition of the duty of information, its origins, the relationship of informed consent with bioethics and the evolution of the physician-patient relationship from a paternalistic to an autonomistic perspective. The study addresses the importance of an adequate standard of conduct for the provision of information, with a focus on its extent, highlighting the difference in the duty of information depending on the type of procedure: therapeutic or aesthetic. Special emphasis is placed on how comparative doctrine and jurisprudence have dealt with these differences and how the reported precedent has not adequately addressed the need to adapt the information to the individual characteristics of the patient, the objective difference in types of procedures, to take the side of a standard of information, as well as other elements developed. The report criticizes the lack of a critical and proactive approach in the precedent to incorpórate these elements, which are vital for a medical practice that not only respects patients' rights, but is more understandable to healthcare personnel. The report concludes by stressing the need for continued reflection to ensure that informed consent fulfills its function effectively.
