Resumen
La falta de protección adecuada y suficiente frente a la contingencia de la vejez, la
cual debe ser atendida por el Sistema Privado de Pensiones (SPP) es un escenario
cada vez más apremiante en el marco de la estructura previsional del Estado. Dicho
contexto surge, principalmente, por la ola de libres retiros de fondos de pensiones
que han disminuido y/o desaparecido los aportes previsionales de los afiliados,
ocurrido desde la dación de la Ley 30425. En ese sentido, el Estado ha decidido en
varias oportunidades colocar a libre disposición y voluntad de los afiliados los montos
previsionales reservados por Ley. Ello, no sólo ha lesionado su intangibilidad, sino
que ha debilitado la finalidad para la que se implementó la seguridad social en
nuestro país, máxime, el Estado es el garante del libre acceso de las prestaciones
de pensiones de toda la población, así como de su supervisión. En ese sentido, el
constante flujo de cambios y el descontento social por la profunda brecha entre el
objetivo del sistema de pensiones y su real eficacia en la protección de los jubilados,
ha sido clave en la responsabilidad y seriedad que este tema merece, a fin de
encontrar un marco jurídico suficiente en el que se evidencie una respuesta clara y
acorde con su finalidad. Consecuentemente, el objetivo del presente artículo es
evaluar la realidad del sistema privado de pensiones debido al libre retiro pensiones
y lo que ha venido a implicar en la realidad pensionaria del país, y si a partir de ello,
es posible cumplir con su objetivo de forma eficaz y progresiva.
The lack of adequate and sufficient protection against the contingency of old age, which must be addressed by the Private Pension System (SPP) is an increasingly pressing scenario within the framework of the State's pension structure. Consequently, the objective of this article is to evaluate the reality of the private pension system due to the free withdrawal of pensions and what it has come to imply in the pension reality of the country, and if, based on this, it is possible to meet its objective. of form. effective and progressive.
