Abstract
La investigación estudia la relevancia del principio de independencia en la Justicia Militar
Policial, debido a que ésta al tener una naturaleza distinta al fuero común, posee
particularidades susceptibles de innovación con el fin que garanticen el respeto al debido
proceso, Estado de Derecho y la democracia en nuestro país. Esto debido a que cuando se
consulta a especialistas en cuanto a la necesidad de una reforma de la justicia militar, tienen
ciertos desacuerdos con respecto al juicio de los Oficiales Militares, Policías retirados y
civiles cuyos crímenes serían prescritos por el Código Penal. Ante lo cual surge la pregunta,
que es el problema de la presente investigación: ¿la independencia en la jurisdicción Militar
Policial se encuentra asegurada por la normatividad vigente?, debido a que el actual marco
normativo no establece las suficientes garantías para concebir la idea de un proceso imparcial
en el tiempo. Por lo cual, se tiene como uno de los principales objetivos de la investigación
el determinar si esa independencia se encuentra asegurada y cuáles son los mecanismos para
lograr asegurarla en la jurisdicción militar-policial. Finalmente, se concluye sobre la
importancia de la permanencia de los Magistrados Militares Policiales, de conformidad con
el ordenamiento jurídico vigente desarrollando su autonomía e independencia administrando
Justicia Militar Policial, de lo contrario corre el riesgo que el magistrado sea influenciado en
sus fallos, lo cual evidentemente perjudica u obstaculiza el cumplimiento del principio de
Independencia Judicial y vicia el procedimiento.
The investigation studies the relevance of the principle of independence in the Military Police Justice, since it, having a different nature from the common jurisdiction, has peculiarities that are capable of innovation in order to guarantee respect for due process, the rule of law and democracy. In our country. This is because when specialists are consulted regarding the need for a reform of the military justice system, they have certain disagreements regarding the trial of Military Officers, retired Police officers and civilians whose crimes would be prescribed by the Penal Code. Before which the question arises, which is the problem of the present investigation: is independence in the Military Police jurisdiction guaranteed by current regulations?, because the current regulatory framework does not establish sufficient guarantees to conceive the idea of an impartial process in time. Therefore, one of the main objectives of the investigation is to determine if that independence is assured and what are the mechanisms to ensure it in the military-police jurisdiction. Finally, it concludes on the importance of the permanence of the Military Police Magistrates, in accordance with the current legal order, developing their autonomy and independence administering Military Police Justice, otherwise there is a risk that the magistrate will be influenced in their decisions, which Obviously it prejudices or hinders compliance with the principle of Judicial Independence and vitiates the procedure
