La Consulta a la Corte Suprema en procesos de amparo contra norma: ¿una figura desfasada?

Abstract
Este artículo tiene como finalidad, ingresar en un tema poco debatido, como es
el de la Consulta a la Corte Suprema frente a la inaplicación de normas en el
proceso de amparo. Es curioso que hasta la fecha no existan mayores artículos
que analicen este tema tan polémico, que ha pasado desapercibido durante
muchos años.
Mi finalidad es poner sobre la mesa el debate de la necesidad de la regulación
de la consulta en una etapa constitucional, evaluar cómo es que la consulta
vulnera principios constitucionales y la naturaleza misma del proceso de amparo
y cuestionarnos si es que dicha regulación debe extinguirse o mantenerse.
En este artículo advertiremos que no todo es blanco y negro, y que, a pesar de
las manifiestas inconsistencias que puedan generarse en base a la consulta y a
las vulneraciones que esta pueda generar, si resulta necesario mantenerla para
salvaguardar principios angulares del Derecho, como son la predictibilidad y
seguridad jurídica. Sin embargo, mantener la consulta sugiere importantes
modificaciones sobre su regulación, respecto a las cuales ahondaré en este
trabajo.
The purpose of this article is to enter into a little debated topic, such as the Consultation to the Supreme Court regarding the non-application of norms in the amparo process. It is curious that to date there are no major articles that analyze this controversial issue, which has gone unnoticed for many years. My purpose is to put on the table the debate on the need for the regulation of consultation at a constitutional stage, to evaluate how consultation violates constitutional principles and the very nature of the amparo process, and to question whether such regulation should be extinguished or maintained. In this article we will note that not everything is black and white, and that, despite the obvious inconsistencies that may be generated on the basis of the consultation and the violations that it may generate, it is necessary to maintain it in order to safeguard key principles of law, such as predictability and legal certainty. However, maintaining the consultation suggests important modifications to its regulation, which I will discuss in more detail in this paper.
