La prejudicialidad como excepción procesal

Abstract

La presente investigación busca ahondar en el análisis de la figura procesal de la Prejudicialidad, partiendo de su naturaleza procesal y sustancial, así como exponiendo su escasa, casi inexistente, regulación en nuestro Código Procesal Civil, además de sus diferencias con la prejudicialidad penal. Así también, se analizan las dos vías existentes en nuestra normativa procesal para lidiar con la cuestión prejudicial, de forma que expongamos los problemas que cada una de estas vías manifiestan a nivel procesal para todas las partes procesales, incluido los jueces. Por último, buscamos plantear una vía alternativa que reside en otra figura procesal bastante conocida: la excepción. De esa manera, analizamos como la prejudicialidad puede ser recogida como una excepción procesal, sin la necesidad de un cambio legislativo, sino en una interpretación de la norma que deberán realizar los directores del proceso: nuestros jueces.

This research aims to explore the analysis of the procedural concept of Prejudiciality, beginning with its procedural and substantive nature, while highlighting its limited, almost non-existent regulation in our Civil Procedure Code, as well as its differences from criminal prejudiciality. Furthermore, we examine the two existing avenues within our procedural framework for addressing the prejudicial issue, in order to outline the challenges that each of these avenues presents at the procedural level for all parties involved, including judges. Finally, we seek to propose an alternative approach that resides in another wellknown procedural concept: the exception. In this regard, we analyze how prejudiciality can be recognized as a procedural exception, without necessitating legislative change, but rather through an interpretation of the rule that must be undertaken by the process directors: our judges
